　　从大理古城情侣裸拍，再到这次洱海边大尺度裸照，所谓“艺术”和“自由”能否凌驾于公共秩序之上？该如何对公共场合的裸拍者说“不”？

　　公共场所屡次曝出“裸照”事件

　　近日，云南大理曝出裸拍事件：有网友曝料称，在大理洱海海舌公园有女子在拍摄裸照，并贴出了若干张大尺度照片。据悉，涉事女子曾回应称系艺术创作和个人行为，拍摄前有清场，照片是他人私自偷拍后传播的。

　　裸照、景区、大尺度……这些本身就是制造噱头的词汇，在这样的公共场合交汇在一起，不论是故意炒作，还是无意之举，都让人愕然。而这也是继不久前的“古城裸照”后，发生在大理的又一起裸拍事件。

　　今年5月，一对情侣夜间在大理古城人民路拍摄裸照并上传网络。其中多张照片显示，两人在街上多个建筑物或人文景点旁，不但裸露身体，还摆出许多不雅的造型 和动作。大理当地警方介入事件调查后，根据治安管理处罚法的规定，涉事情侣因涉嫌利用信息网络传播淫秽信息，分别被处以行政拘留15日和13日。

　　然而，这样的处罚并没有能给类似“闹剧”画上句号。历史文化名城大理接连遇到“裸照”尴尬，引来部分网友热议。有网友表示，多元社会文化下，裸体拍摄是对 艺术的一种追求，也是他人自由，不应干涉；也有网友认为，在公共场合进行裸体拍摄的行为不仅关系个人，还要考量对社会造成的影响。

　　记者梳理发现，近些年来，在景区等公共场所拍裸照已不是个案现象，而当事人多以“艺术创作”或“个人自由”来解释自己的行为。

　　“每个人都有自己的行为方式，随着人们态度的宽容，观念的变化，对待裸照，也不再是一棒子打死。”大理市民邓先生说，但不知道从什么时候起，在景区过度暴露身体拍照成为一部分人追求的一种“艺术”和对“自由”的诠释。

　　南开大学副教授张志红说：“我们尊重真正的艺术创作，但是不能让艺术创作带上色情的色彩。”

　　记者从大理市有关部门了解到，针对此次洱海边裸拍事件，当地警方目前已经介入调查。

　　“艺术”“自由”能否成为凌驾于公共秩序的挡箭牌？

　　明知不恰当，却依旧我行我素，这些年，在“艺术”“自由”的挡箭牌下，公共场合裸拍正在愈加频繁地闯入公众视界。昆明盈科律师事务所律师李承蔚认为，公共 场所上演“不雅行为”，一方面是人们的思想逐步开放，表达情绪的方式更直接了；但值得警惕的另一方面是，部分人员在公共场所里不顾及他人感受，彰显公共空 间意识不足、文明素养缺失、法律意识薄弱。

　　“‘艺术’创作，要有尺度，有底线，分场合。在少数民族聚居地区公众场合以‘艺术’之名进行裸拍，当事人是否考虑过需要尊重当地的信仰和文化？”大理当地 人士施怀基说，艺术创作不能违反基本的社会秩序，不能损害公众利益。我国传统的道德观和当今社会秩序并不容许公众场合之下进行“裸拍”的行为。

　　李承蔚认为，现阶段拍裸照等“艺术”在国内的受众面还是相对狭小的，在景区等公共场合拍摄裸照，是在恣意扩大受众面。从小处讲，给公众造成了视觉污染；从大处讲，妨碍了社会公共秩序，违反了良好的社会风尚，其潜在的负面效应不容小视。

　　“屡屡出现的公共场所裸拍，客观上表明部分民众并没有将自己置身于社会链条中，考虑他人的感受，尊重他人的权利、乃至社会公德和公序良俗，不仅将艺术泛 化，而且将自由无限扩大。”云南大学社会学教授金子强说，此类“艺术”在私密场合进行，不影响他人，未尝不可。但是，一旦到了公共场合，就不恰当了，甚至 会触犯相关法律法规。

　　“所谓‘艺术’‘自由’不能成为凌驾于公共秩序的挡箭牌，一些人缺乏自我约束力，缺乏对社会起码的责任感，缺乏判断事物对错的标准，和社会的风尚引导及政府管理有关。”李承蔚说。

　　挡不住的“裸”？

　　给予一些现象必要的包容，是当下社会进步的表现。但有关人士同时表示，包容不是无原则的，包容或者争议都应立足于是非对错。“对此类事件，相关部门如果不 表达态度、不发声、不抵制、不批评，就是纵容，从社会教育角度来讲将会形成不好的示范。”金子强说，不断出现这样的“闹剧”，不得不让我们去反思。

　　李承蔚说：“要加强法律的宣传普及，让公众一方面知道个人行为的边界，另一方面可以评判他人行为是否涉法。监管部门或景区等要加强提示和宣传，规劝公民在享受自由权利的同时，不扰乱他人利益和社会秩序等。”

　　在谈到如何监管、处理、预防此类事件时，施怀基建议，有关部门可以在一些公众场合增加警示标志。此外，对于在公众场合以艺术之名“裸拍”的当事者，根据影响程度，列入不受欢迎游客名录，依法进行训诫、教育，甚至罚款。

　　“社会越开放越需要自律，环境越宽松越需要自觉。”金子强说。维护良好社会公德秩序，营造积极健康的社会氛围，还需加强社会公德教育，加强对社会乱象的反思。
