从法律上怎样界定恶性差评?律师告诉记者,从民事责任的角度来看,如果买家恶意差评或者商家威胁买家的情况,均可以要求对方承担赔礼道歉、恢复名誉、赔偿损失等侵权责任。如果是商家通过买通O2O平台内部的人员进行删帖的话,那么就涉嫌商业贿赂罪。如果是通过技术手段侵入O2O平台内部系统进行删帖,则是非法侵入计算机系统罪。此两种行为,情节严重的将被追究刑事责任。

平台:正在完善评价功能的“过滤审核程序”

记者了解到,众多平台正在完善评价体系的“过滤审核程序”。以“饿了么”为例,在饿了么APP上,用户对餐品评价完成后,商户仅能看到评价内容,但无法看到用户的手机号和地址等个人信息。

律师:政府、平台监管有漏洞

山东齐鲁律师事务所律师马强表示,从行政层面,政府对于第三方平台缺乏到位的监管,存在大量的法律漏洞;另一方面,如果仅仅靠政府其实很难管住每一个送餐员和餐厅,规范的细化管理是订餐平台无可推卸的责任。
