1问 征求意见稿是怎样修改的？

去年10月10日到11月9日，交通运输部网站和国家法制办网站同步将《指导意见》和《暂行办法》的征求意见稿向社会公开，一个月的时间里，引起了各界的广泛关注。
“比如针对网约车平台的管理方式、网约车车辆的性质以及报废的标准等一些问题，民众关注度特别高，争议也比较大。我们搜集了10个方面6000多条意见和建议。”刘小明说。
从征求意见稿的争议大到如今新规的满意度提升，这些意见和建议是如何在正式版的法规中体现的呢？
刘小明介绍，与《指导意见》相比，《暂行办法》的修改比较多：一是网约车的车辆登记性质，调整为预约出租客运，既体现了网约车确实是出租汽车的性质，也反映了新业态的特征。二是关于网约车车辆的报废标准的修改，给了网约车一个更宽松的空间。三是明确可以签订多种形式的劳动合同或协议，更加适应网约车灵活用工的特点。四是优化许可的程序，修改后实施“两级工作、一级许可”。五是从四个方面对信息安全进行了规定。
“除了以上五个主要方面，大家在比较的过程中也会发现，在网约车标识、计程计时方式、促销奖励方案提前公告、租价机制等方面都做了调整，调整的过程中有宽有严，原则就是更加适合于网约车新业态的特点，体现以乘客为本，体现鼓励创新和管住底线。”刘小明补充道，“目前网上有很多网民，包括很多专家也非常细心，把两个文件和之前的征求意见稿做了一个比较，比较之后确确实实感觉到我们这次是真听意见，而且这些意见的修改都经过了充分的论证，政府确确实实是在开门立法、广纳民意，集中大家的智慧。”

在巡游车如何发展方面，刘小明认为，巡游车司机非常讲大局，也确实感觉到原来巡游车在服务上面有不足的地方，也看到了网约车在这方面做得好的地方，得到社会的认可。
就平等竞争而言，刘小明介绍，对网约车进行规范管理是公平的基础。车辆以及人员的准入、平台的准入、价格机制、报废、税费缴纳等等方面都要规范，网约车不能野蛮生长，如果没有这些规范，对于巡游车来说就将是巨大的冲击。
此外，明确在新老业态当中，网约车和巡游车要实施错位经营，也是力促公平，希望二者在同一起跑线上竞争。
“两者必须公平竞争，用服务赢得老百姓，赢得各自的发展。当然各地政府在具体实施过程中还得充分平衡好利益关系。”刘小明说。
此外，刘小明介绍，此次改革有利于降低驾驶员负担，从四个方面减少份子钱：
一是改革经营权管理制度，新增出租汽车的经营权一律实行期限制和无偿使用，而且不得改变经营的主体。“原来有些城市的经营权有偿使用费达到50万元、60万元甚至100万元，平摊到份子钱就是很大一块。改革后拿掉了经营权有偿使用费，会在一定程度上降低份子钱。”他说。
二是规范承包经营方式。采取承包经营方式的承包人，必须要取得个体从业者资格，直接从事工作，避免中间转包。
三是建立份子钱的集体协商机制，即行业协会代表企业、工会组织代表驾驶员进行平等协商，政府参与其中进行平衡，更多保护驾驶员的权益，同时也保护企业的权益。
四是利用互联网技术构建风险共担、利益共享的新经营模式，“比如明确一单中，哪些企业拿，哪些应该驾驶员留下。”刘小明举例说。
“希望两个文件的出台，对于乘客、网约车驾驶员、巡游车驾驶员都是利好。”刘小明说。

平台担责，守住底线，加强监管
出行，最基本要求在于安全。近年来，网约车在方便了大家出行的同时，也带来一些新的安全风险，这也是老百姓最为关注的问题之一。
“我们在制度设计时，将保障乘客出行安全作为交通运输服务的底线要求，这是不能逾越的红线。”据刘小明介绍，为此《暂行办法》从四个方面作出了规定：
加强事前准入把关。通过对企业、车辆、驾驶员的资质认定，对安全服务基本条件和能力进行事前把关，把住入口，防止明显不适宜从事客运服务的企业、车辆和人员进入行业，守住安全底线。
加强事中事后运营监管。要求网约车平台公司落实主体责任，发挥其技术优势，通过信息化手段加强营运过程安全和服务管理；同时各地要建设和完善政府监管平台，实现与网约车服务平台的信息共享，加强对企业经营行为和日常营运全过程的监管。
加强社会信用评价。通过建设经营者及驾驶员信用体系并纳入全国信用信息共享平台、开展服务质量测评并及时向社会公布等方式，保障乘客知情权及选择权，利用社会监督手段提高网约车服务质量。
明确网约车平台公司承担承运人责任。“网约车原来没有规范，乘客安全性得不到保证，发生纠纷后乘客的利益得不到保障。”刘小明表示，明确平台企业为承运人后，可以厘清运输服务过程中各方权责，一旦发生事故有明确的责任主体，保障乘客和驾驶员等各方的合法权益，减少纠纷。
