1问 征求意见稿是怎样修改的?

去年10月10日到11月9日,交通运输部网站和国家法制办网站同步将《指导意见》和《暂行办法》的征求意见稿向社会公开,一个月的时间里,引起了各界的广泛关注。

从征求意见稿的争议大到如今新规的满意度提升,这些意见和建议是如何在正式版的法规中体现的呢?

刘小明介绍,与《指导意见》相比,《暂行办法》的修改比较多:一是网约车的车辆登记性质,调整为预约出租客运,既体现了网约车确实是出租汽车的性质,也反映了新业态的特征。二是关于网约车车辆的报废标准的修改,给了网约车一个更宽松的空间。三是明确可以签订多种形式的劳动合同或协议,更加适应网约车灵活用工的特点。四是优化许可的程序,修改后实施“两级工作、一级许可”。五是从四个方面对信息安全进行了规定。

“除了以上五个主要方面,大家在比较的过程中也会发现,在网约车标识、计程计时方式、促销奖励方案提前公告、租价机制等方面都做了调整,调整的过程中有宽有严,原则就是更加适合于网约车新业态的特点,体现以乘客为本,体现鼓励创新和管住底线。”刘小明补充道,“目前网上有很多网民,包括很多专家也非常细心,把两个文件和之前的征求意见稿做了一个比较,比较之后确确实实感觉到我们这次是真听意见,而且这些意见的修改都经过了充分的论证,政府确确实实是在开门立法、广纳民意,集中大家的智慧。”

就平等竞争而言,刘小明介绍,对网约车进行规范管理是公平的基础。车辆以及人员的准入、平台的准入、价格机制、报废、税费缴纳等等方面都要规范,网约车不能野蛮生长,如果没有这些规范,对于巡游车来说就将是巨大的冲击。

此外,明确在新老业态当中,网约车和巡游车要实施错位经营,也是力促公平,希望二者在同一起跑线上竞争。

“两者必须公平竞争,用服务赢得老百姓,赢得各自的发展。当然各地政府在具体实施过程中还得充分平衡好利益关系。”刘小明说。

此外,刘小明介绍,此次改革有利于降低驾驶员负担,从四个方面减少份子钱:

一是改革经营权管理制度,新增出租汽车的经营权一律实行期限制和无偿使用,而且不得改变经营的主体。“原来有些城市的经营权有偿使用费达到50万元、60万元甚至100万元,平摊到份子钱就是很大一块。改革后拿掉了经营权有偿使用费,会在一定程度上降低份子钱。”他说。

二是规范承包经营方式。采取承包经营方式的承包人,必须要取得个体从业者资格,直接从事工作,避免中间转包。

三是建立份子钱的集体协商机制,即行业协会代表企业、工会组织代表驾驶员进行平等协商,政府参与其中进行平衡,更多保护驾驶员的权益,同时也保护企业的权益。

四是利用互联网技术构建风险共担、利益共享的新经营模式,“比如明确一单中,哪些企业拿,哪些应该驾驶员留下。”刘小明举例说。

“希望两个文件的出台,对于乘客、网约车驾驶员、巡游车驾驶员都是利好。”刘小明说。

3问 网约车乘车安全谁来保障?

平台担责,守住底线,加强监管

出行,最基本要求在于安全。近年来,网约车在方便了大家出行的同时,也带来一些新的安全风险,这也是老百姓最为关注的问题之一。

“我们在制度设计时,将保障乘客出行安全作为交通运输服务的底线要求,这是不能逾越的红线。”据刘小明介绍,为此《暂行办法》从四个方面作出了规定:

加强事前准入把关。通过对企业、车辆、驾驶员的资质认定,对安全服务基本条件和能力进行事前把关,把住入口,防止明显不适宜从事客运服务的企业、车辆和人员进入行业,守住安全底线。

加强事中事后运营监管。要求网约车平台公司落实主体责任,发挥其技术优势,通过信息化手段加强营运过程安全和服务管理;同时各地要建设和完善政府监管平台,实现与网约车服务平台的信息共享,加强对企业经营行为和日常营运全过程的监管。

加强社会信用评价。通过建设经营者及驾驶员信用体系并纳入全国信用信息共享平台、开展服务质量测评并及时向社会公布等方式,保障乘客知情权及选择权,利用社会监督手段提高网约车服务质量。

明确网约车平台公司承担承运人责任。“网约车原来没有规范,乘客安全性得不到保证,发生纠纷后乘客的利益得不到保障。”刘小明表示,明确平台企业为承运人后,可以厘清运输服务过程中各方权责,一旦发生事故有明确的责任主体,保障乘客和驾驶员等各方的合法权益,减少纠纷。
