IT资讯讯 8月7日消息,近日,国家工商总局公布了《消费者权益保护法实施条例》(征求意见稿),意见稿中规定,经营者不得擅自扩大不适用无理由退货商品的范围,拆封商品也可以“无理由退货”。

消费者退货时,商家一般都会要求商品完好,甚至要求商品不得拆封、试用,然而现在这种要求已经不合理,上述意见稿规定,商品能够保持原有品质、功能,包括商品本身、配件、商标标识、使用说明书等齐全的,视为商品完好。消费者基于查验需要而打开商品包装,或者为确认商品的品质、功能而进行合理的调试不影响商品的完好,经营者应当在签收退回商品之日起七日内向消费者返还已支付的货款。

而对拆封后易导致商品性质改变、影响人身安全或者生命健康的商品;一经激活或者试用后价值贬损较大的商品;销售时已明示的临近保质期的商品、有瑕疵的商品等情况,可以不适用七日无理由退货规定。但未经消费者确认的,经营者不得拒绝七日无理由退货。

另外意见稿中还规定,未经消费者明确同意或者请求,经营者不得向其发送商业性电子信息或者拨打商业性推销电话。经营者及其工作人员不得泄露、篡改、毁损其收集的消费者个人信息;未经消费者同意,不得向他人提供消费者个人信息。经过处理无法识别特定消费者且不能复原的除外。
