　　中新网防城港8月12日电 （李敏军 吴凰汇 廖家胜）发生在广西防城港市一娱乐会所、导致2死4伤的恶性枪击案，广西防城港市中级法院12日开庭审理，三名被告人因涉嫌犯故意杀人罪、非法持有枪支罪、窝藏罪等罪名受审。

　　公诉机关指控，2015年8月13日凌晨，被告人卢某与被告人杨某、唐某等人在防城港市港口区某娱乐会所喝酒期间，接到被害人张某的电话及信息，到另一个娱乐会所喝酒，卢某认为张某是在挑衅。

　　当日4时许，卢某与杨某、唐某等人带上枪支和刀具去到B会所。卢某与杨某进入陈某所在的包厢后，卢某掏出手枪先后朝被害人张某、黄某等人射击，杨某亦拿匕首向对方的人乱刺乱捅，随后在杨某的协助下逃离。

　　此次冲突，造成张某当场死亡，黄某经送往医院抢救无效后亦死亡，另有4人受伤。

　　案发后，三被告人于2015年8月14日向公安机关主动投案。

　　公诉机关认为，被告人卢某、杨某的行为导致两死四伤的后果，应当以故意杀人罪追究其刑事责任，在共同犯罪中，卢某、杨某均为主犯，且卢某非法持枪，应当以非法持枪罪追究其刑事责任。被告人唐某协助逃匿，应当以窝藏罪追究其刑事责任。

　　法庭上，公诉机关出示了相关证据，其中卢某的供述认为，其因马仔“废宝”投靠被害人张某而与张某结怨，且张某一直发信息对其进行挑衅，案发当晚，张某又发短信来挑衅，其认为张某欺负他、打压他。

　　卢某在庭审中称，他只是想去谈和，带枪是为了防身，案发当晚他吸毒了。
