北京一镇委书记贪贿3400万 获刑16年罚120万
“被控贪贿3400万 回龙观镇原书记受审”追踪
新京报讯 （记者李禹潼）利用房企老总及镇委书记的职务便利收受财物1400余万，还伙同他人侵吞2000万公款（新京报5月13日报道）。记者昨日获悉，曾任昌平区镇党委书记的郭向东一审因犯受贿罪、贪污罪被二中院判处有期徒刑16年，并处罚金120万。
受审时称“不得已”收钱
今年48岁的郭向东，历任北京市昌平房地产开发有限责任公司（以下简称昌房公司）党委书记、总经理，北京铭嘉房地产开发有限公司（以下简称铭嘉公司）董事长、总经理，昌平区百善镇委员会党委书记、回龙观镇委员会党委书记。
法院经审理查明，2004年至2007年间，郭向东利用担任昌房公司党委书记、总经理的职务便利，伙同某温泉公司法人裴某某（另案处理），在昌房公司向某房地产公司转让某小区项目的过程中，虚构该项目转让系温泉公司介绍并促成的事实，以支付温泉公司中介费的名义，骗取昌房公司人民币2000万元，后予以侵吞。
2004年至2014年间，郭向东先后利用在昌房公司、铭嘉公司以及昌平区百善镇、回龙观镇担任领导干部，全面负责昌房公司、铭嘉公司经营管理，主持百善镇、回龙观镇工作的职务便利，为他人谋取利益，多次收受他人给予的财物共计折合人民币1413万余元。
开庭受审时，郭向东对被指控的罪名认罪悔罪，称送钱者有一些是领导，收钱属不得已。此外，郭向东收钱后曾将钱款退还，但后被再次退回。
法院一审认定郭向东构成贪污罪和受贿罪，以贪污罪判处有期徒刑12年，以受贿罪判处有期徒刑12年，决定执行有期徒刑16年，并处罚金120万元。
收受贿赂原区长当“掮客”
新京报记者注意到，郭向东提出的“收钱后退还，后再次被退回”，发生在曾经的上级——昌平区原区长佟根柱及情妇庞建贞身上，目前二人均已被判刑。
法院认定，2004年到2005年间，郭向东利用担任昌房公司党委书记、总经理的职务便利，为史某的房地产公司取得昌房公司歇甲庄项目开发权提供帮助，收受史某给予的50万元。
佟根柱的证言证明，其担任昌平区区长期间，地产商史某找其帮忙，希望与昌房公司合作进行土地开发。佟根柱找到昌房公司负责人郭向东，介绍二人达成合作。
佟根柱称，郭向东曾将史某给予的50万人民币交给庞建贞，庞建贞问自己怎么处理，其让庞建贞把这50万元又交给郭向东。
