郭利，48岁，北京人，2008年“三聚氰胺奶粉事件”受害儿童父亲。向奶粉的生产方施恩（广州）婴幼儿营养品有限公司及其控股股东广东雅士利集团股份有限公司（以下简称“广东雅士利”）维权、索赔。
在与施恩公司签订和解协议，后者赔偿40万元后，郭利提出300万元赔偿要求。
施恩公司及广东雅士利向警方报案。因敲诈勒索罪，他被广东潮安县法院判处有期徒刑五年。2014年，郭利刑满释放。此后继续申诉。

郭利：庭审一直按照程序进行，我还和广东省人民检察院的人在辩论。

剥洋葱：谈谈你的案子吧。
郭利：2009年7月，我被广东潮州潮安县警方以涉嫌敲诈勒索罪带走。2010年1月，潮安县法院一审判决我犯敲诈勒索罪，判处有期徒刑五年。
我后来上诉，潮州中院在没有通知律师的情况下，作出终审裁判，维持原判。
因为是明显的程序错误，经过申诉，广东高院让潮州中院再审。潮州中院后来裁定，“审判程序合法，量刑并无不当。”
我坚持申诉，2015年5月，广东省高院再次作出再审决定，并决定提审此案。

郭利：2008年9月，我接到社区的电话，说北京市卫生局通知让有小孩儿的家庭，带孩子去医院检查肾脏。
我带着女儿去医院检查，结果是“双肾中央集合系统内可见数个点状强回声”，孩子的肾脏功能已经受损。
剥洋葱：你怎么确定是施恩奶粉导致的？
郭利：检查发现女儿肾脏有问题后，医院工作人员让我登记了女儿食用的奶粉，这让我警觉了。
我将女儿的症状与卫生部门公布的“三聚氰胺”受害儿童的症状进行了对比，发现十分相似。2006年，我的女儿出生后，“美国施恩婴幼儿奶粉”是她唯一的奶粉食品。施恩也在三聚氰胺事件涉及的品牌里。
我把家里的奶粉找了出来，去做检测。检测结果显示，奶粉三聚氰胺含量高的达到每千克132.9毫克，少的也有二、三十毫克。国家标准奶粉中三聚氰胺的限量值是1毫克，这就是超标了几十倍到一百多倍。

郭利：我去找了厂家的人，他们不承认奶粉有问题。
之后，我查出施恩并非宣称的百分百进口奶源。中国施恩公司的股权信息显示它是广东雅士利公司控股的。中国施恩公司还声称奶粉是美国施恩公司授权生产的，我通过美国朋友查到，美国施恩实际上是一个空壳公司，没有生产设备。
所以实际上，施恩就是广东雅士利下面的一个假洋品牌。我把相关的内容告诉媒体后，施恩公司主动联系我了。
剥洋葱：你们怎么谈的？
郭利：2009年6月13日，施恩公司和我签了和解协议，赔了40万，我答应不再追诉并放弃赔偿。
在达成协议之前，我答应了北京电视台的采访。6月25日，节目播出了。6月29日，施恩和我联系上，说我可以书面提出赔偿要求。
我查了资料后，觉得这个事情有可能损害孩子一生的健康，所以提出300万元的赔偿要求，这实际上是参考了保险公司的数据等计算出来的医疗保障。
我后来被抓了才知道，他们6月30日就报警了，但他们后来一直在和我接触，激怒我说出一些过激的话，然后录音。
7月22日，我在杭州被广东省潮州市潮安县的警察抓了。施恩是在广州注册的，雅士利是潮州注册的。施恩的法定代表人和雅士利的总裁是一个人，他是潮安人。

剥洋葱：在监狱里，生活怎么样？
郭利：我和许多狱警就这件事辩论过，谁也无法说服谁。他们认为事情的起因是我给孩子吃了这样的奶粉。
头两年，我是和其他人一起住的，监狱要求其他犯人不许和我说话。后来有犯人和我接触后，知道我是因为这个事情进来的，也不欺负我了，都很尊重我，有时候还会保护我。

郭利：我根本没有犯罪，为什么要认？而且，认罪了，就是背叛和对不起我女儿。

郭利：我一方面进行心理调整，一方面照顾身体不好的母亲，并努力重启正常生活。
