北京环保宣传中心原主任贪140万 签假合同套公款
北京市环境保护宣传中心原主任张宝森，此前因常用消费卡大吃大喝被举报，经北京市纪委调查后，自己又交代多起贪污受贿事实，涉及财物近140万元。北京晨报记者昨天获悉，近日海淀法院一审以贪污罪、受贿罪，判处张宝森有期徒刑5年2个月，并处罚金40万元。
手段一 签订虚假合同套取公款
去年3月27日，海淀法院公开审理了本案，近日该院做出一审判决。记者注意到，法院认定了张宝森8起犯罪事实，其中3起均与北京市京海通联国际科技会展有限公司有关。2008年5月至6月间，张宝森通过与该公司签订虚假合同的方式，套取了公款22.7万元，并占为己有。
据59岁的张宝森供述，其在担任环保宣传中心主任期间，管理中心的全面工作，对于中心的全部工作都具有决策权，在财务上更是“一支笔”。2008年上半年，京海通联公司参与了市环保宣传中心组织的一个绿色奥运展览活动，因中心在活动中多出一笔费用，张宝森就想通过该公司把这笔钱转出私吞。
随后，张宝森与京海通联公司的吴某联系，告知需要将此笔钱通过业务合同款的名义先打到对方公司，剩余的钱再以现金的方式提出交给他。之后，宣传中心打着在中华世纪坛举办展览的名义，与京海通联公司签订了业务合同，不久吴某就打电话给张宝森，告知钱已转出，并用现金方式进行了交付。
张宝森此后如法炮制，又多次采取类似签订虚假合同的手段，套取大量公款用于购买理财产品等。
手段二 私吞单位消费储值卡
除了贪污公款外，张宝森还指使他人用单位的公款18万余元，办理了北京四季御园餐饮服务有限公司等多个消费场所的消费卡10张，供自己使用。
据张宝森供述，2012年底，宣传中心本来准备在一家酒店开会，随着中央八项规定出台，这个会没有开成，他就从会计手里将付款证明要回，自己去酒店交了单子，让酒店把两万多元的会议费用改成2张记名储值卡，并登记了自己和妻子的名字，后被他消费掉了。
在张宝森卸任前的2013年5月，他还想办一张四季御园餐馆的储值卡供自己吃饭消费。为了达到目的，张宝森让办公室主任何某填写了一张限额2万元的借款单，并领出支票，然后他拿着这张支票去餐馆办了一张1.05万元的餐馆储值卡，回来后张宝森再将发票交给了何某进行财务平账。
手段三 私吞报社返还组稿费
除了上述手段外，张宝森还利用职务便利，与报社签订宣传协议趁机收取回扣。据中国环境报社工作人员邹某称，2013年，报纸开始做地方环境宣传专版内容，实质属于广告。邹某找到张宝森后，二人商议以12万元的价格刊登两期宣传专版，报社还会按照版面费用的40%作为组稿费，打到张宝森指定的账号。
在报社将4.3万元的组稿费返给张宝森后，其不仅没有督促下级部门进行实际组稿，也未给报社提供过任何稿件，而是将该笔费用占为己有，事后也未就宣传一事再与报社联系，花了12万元的专版最后不了了之。
一审 数罪并罚获刑5年2个月
法院经审理认为，张宝森身为国家工作人员，利用职务便利非法占有公共财物，数额巨大，其行为已构成贪污罪，应予惩处。同时，张宝森索取他人财物，数额较大，其行为已构成受贿罪，应与其所犯贪污罪并罚。鉴于张宝森到案后及在庭审过程中能如实供述其所犯大部分罪行，且在亲属协助下退缴了涉案赃款，有悔罪表现，故法院对其依法从轻处罚。
综合全案，海淀法院一审以贪污罪，判处张宝森有期徒刑5年，罚金30万元；以受贿罪，判处有期徒刑6个月，罚金10万元，决定执行有期徒刑5年2个月，罚金40万元。
