骗子伪装成客服骗走电视

晨报记者从双方的聊天记录中发现,这位自称易到客服的男子,要求史女士将电视寄往北京乐视。因为当时电视还未送达,史女士就打算直接将配送地址改成易到公司,却遭到了该男子的拒绝,并称:“已经配货了,我们和乐视协商了,(这样)不行。”

7月23日,史女士再次致电乐视客服,客服告知她可直接拒绝签收电视。

为此,史女士再次询问该男子,他答道:拒签,易到就不管了,那就是您和乐视的事了。同时,该男子还强调“一定要先签收后让快递再寄送”、“送达后立马联系我”。

最终,这款电视机于7月28日送达史女士家中。根据该男子给出的地址,史女士次日就将其寄往北京市大兴区旧宫镇南小街东里芳源里北门乐视TV,联系电话为010-57036635。

7月29日,史女士将单号发送给该男子后,就再也没有收到任何回复。

此后,这位自称是易到客服的男子便没了音讯,微信不回,座机电话也已暂停服务,史女士这才怀疑可能遇到了骗子。随后,她拨打易到客服电话,告知自己的遭遇,客服表示该公司并没有这样的人,也没有答应给任何人受理过此类退款。

南京一女子遭遇类似骗局

无独有偶,晨报记者在采访中了解到,南京的小李与史女士的遭遇十分相似。李小姐在参与该活动充值3600元后,因故要求退款,遭到拒绝后同样收到了自称易到客服的人打来的电话。与史女士不同的是,小李当时仍未使用过兑换码。因此,这位自称客服的人士直接骗取了小李的电视兑换码。

得知被骗后,小李立刻联系了乐视和易到客服,并向当地警方报警。据小李透露,乐视公司通过该兑换码留下的信息,查询到一位江西南昌的张姓人士,在一个南昌当地的网站“地宝网”上,经营着一家“Letv乐视生活体验店”。

令人震惊的是,史女士和小李接到的自称易到客服的座机电话,居然是同一个座机号码010-57036635。

成立公司内部调查小组

骗子究竟是如何知道被害人信息的,又是如何了解到有退款需求的呢?晨报记者联系了易到公关部相关负责人,她表示该公司了解到史女士的经历后,成立了公司内部调查小组,对内部接触到用户信息的人进行排查。同时,该公司还将通过技术手段及风控手段来寻找这一诈骗组织:“我们也会联系当事人,寻求警方帮助,并随时提供有用的信息。”

8月9日,晨报记者以用户的身份致电易到客服,称自己上个月参与了充值送电视的活动,并询问现在是否还可以申请退款。客服人员拒绝了退款要求,并表示:“7月28日之前参加充返活动以及未参加任何活动的用户余额,都不予以退款。”此后,客服人员告诉记者,自7月28日起,在易到充值的用户可在充值车费后7日内申请退款。

若平台信息泄露应担责

上海市融孚律师事务所杨维江律师认为,消费者首先要阅读类似于使用须知的约定,如果约定里明示了退款条件,那就应严格依约履行;但是,由于退款条件是关乎消费者利益的重要条款,易到用车作为经营者,应该对消费者做出特别提示,以便消费者选择是否接受并继续交易。如果事先没有约定,易到用车只在纠纷发生后以所谓最终解释权解释退款规则,那就不妥了。
