　　法院查明，多起受贿事实系企业老板出资供陈海鞠赌博。

　　赌博是陈海鞠的爱好，他多次在代表单位出国进行商务谈判期间进入赌场豪赌，7天行程的商务谈判曾有4天在赌场度过，一次甚至刚下飞机就抛下同行人员和接待人员直奔赌场。

　　退休东航副总 在家中被带走

　　根据东航集团的公开资料显示，1950年出生的陈海鞠毕业于厦门大学世界经济系，拥有硕士学位。

　　1973年，进入民航业工作，先是在民航徐州站调度室任调度员，随后步步高升。

　　1999年10月至2003年11月，陈海鞠先后担任中国民用航空总局空中交通管理局局长、党委副书记，兼任空管工程建设指挥部指挥长等职。

　　2003年11月至2011年5月，陈海鞠任中国东方航空集团公司副总经理，兼任东方航空食品投资有限公司、上海东方航空食品有限公司董事长，上海航食公司浦东二期工程项目领导小组组长。

　　2013年6月8日，已经退休两年多的陈海鞠在家中被纪委办案人员带走，一个月后被依法逮捕。

　　同年11月，上海市人民检察院第一分院向法院提起公诉。

　　行贿人：没想到高级领导这么嗜赌！

　　据中国新闻网报道，陈海鞠喜欢搓麻将，尤其喜欢和有业务交往的私企老板们一起搓麻将。下班后、双休日，他总是召集“牌搭子”在企业的棋牌室里搓麻将，常常通宵达旦。

　　由于和私企老板们玩麻将“常胜”，陈海鞠开始不满足了，渐渐对外国的赌场感兴趣。

　　深读（微信ID：shenduzhongguo）获悉，陈海鞠第一次到外国赌场是2003年。这一年，时任民航空管局局长的陈海鞠率团赴澳大利亚墨尔本，代表民航空管局与外商签约。这次出差期间，陈海鞠走进了墨尔本皇冠赌场。

　　据法院事后查明，在这次赌博中，陈海鞠收受中航材招标公司副总经理闫某给予的赌资5000澳元。

　　案发后，行贿人闫某交代：“我第一次和陈海鞠在皇冠赌场碰面时，没想到一个高级领导居然这么嗜赌。当时我没有准备，就给他换了5000澳币筹码。”

　　从此以后，陈海鞠经常利用出公差的机会在境外豪赌，有时候甚至一下飞机就直奔赌场，将同行的人及接待人员抛在脑后。有一次，总共7天的商务谈判行程，他竟有4天在赌场里度过。

　　据法院查明，2008年9月、2009年6、7月，陈海鞠在美国拉斯维加斯先后收受蒋某提供的赌资25万美元。

　　2012年7月，陈海鞠在澳门收受蒋某提供的赌资20万港元。

　　不仅自己捞钱，陈海鞠退休的妻子也搭上了丈夫的便车。

　　法院查明，2008年4月至2013年6月，陈海鞠认可妻子朱某收受刘某通过深圳空管通信公司以“顾问费”名义支付的36万余元，而实际上，他的妻子朱某即未在深圳空管通信公司工作，也未提供任何劳务。

　　民航工程成寻租工具

　　法院查明，2001年至2013年，陈海鞠为他人承接工程等事项提供帮助、谋取非法利益，分别收受刘某、冯某给予的购房款260万元，刘某支付给陈海鞠妻子“顾问费”36万余元，闫某给予赌资5000澳元（折合人民币2.47万余元），蒋某给予赌资25万美元、20万港元（共折合人民币186.9万余元），马某给予价值5500元的鸡翅木根雕工艺品一件。

　　2001年，陈海鞠利用担任民航空管局局长兼空管工程建设指挥部指挥长的职务便利，为民航通信深圳公司总经理刘某承接民航上海区域管制中心配套弱电系统工程提供帮助，后民航通信深圳公司承接了该项工程。

　　2002年，深圳府林设计有限公司法定代表人冯某为参与华北空管局的工程项目，通过陈海鞠介绍认识了华北空管局局长兼华北地区空管工程分指挥部指挥长段始黎，陈海鞠要求段在工程承接上对冯某予以关照。

　　2002年4月，冯某以深圳新科特种装饰工程公司名义承接了民航北京区域管制中心屏蔽及精装潢工程。

　　2002年，陈海鞠向民航华东空管局局长兼空管工程建设华东分指挥部指挥长张某等人推荐冯某，要求在民航上海区域管制中心精装潢工程承接上对冯某予以关照。

　　2002年10月，冯某以深圳粤航装饰设计工程公司名义承接了民航上海区域管制中心精装潢工程。

　　2004年7月，陈海鞠在购买上海市华泾路一处房产时，向刘某借款100万元，向冯某借款160万元；2004年11月，应陈海鞠要求，刘某转款100万元给冯某，用于归还陈海鞠购买前述房产时向冯某所借的部分钱款。至案发，在有能力归还的情况下，陈海鞠对刘某的200万元、冯某的60万元一直未还。

　　2007年，陈海鞠利用担任东航集团副总经理兼上海航食公司浦东二期工程项目领导小组组长的职务便利，为刘某承接工程提供帮助，后刘某担任法定代表人的深圳空管通信公司承接了上海航食公司浦东二期扩建工程弱电项目。

　　二审中刑（九）出台 终审改判13年

　　上海市第一中级法院一审认为，陈海鞠身为国家工作人员，利用职务上的便利，为他人谋取利益，索取或者收受他人财物共计486万余元，构成受贿罪。

　　2015年3月19日，上海一中院以受贿罪判处陈海鞠无期徒刑，剥夺政治权利终身，并处没收个人全部财产，受贿违法所得予以追缴。

　　深读（微信ID：shenduzhongguo）获悉，一审宣判后，陈海鞠上诉，提出其在工作上有过贡献且身患多病，请求法院给予宽大处理。

　　上海市高级人民法院二审审理期间，《刑法修正案（九）》及《中国最高人民法院、中国最高人民检察院关于办理贪污贿赂刑事案件适用法律若干问题的解释》发布实施。

　　修订后的刑法规定，受贿数额特别巨大或者有其他特别严重情节的，处10年以上有期徒刑或无期徒刑，并处罚金或者没收财产；数额特别巨大，并使国家和人民利益遭受特别重大损失的，处无期徒刑或者死刑，并处没收财产。

　　根据最新的司法解释，受贿数额在300万元以上的，应当认定为数额特别巨大，处10年以上有期徒刑、无期徒刑或者死刑，并处罚金或者没收财产。

　　法院认为，陈海鞠索取、收受贿赂数额486万余元，一审法院根据1997年刑法规定对陈海鞠的量刑适当，但在二审法院审理期间，鉴于法律发生变化，及陈海鞠具有认罪悔罪情节，一审法院对陈海鞠量刑过重。

　　2016年6月24日，上海市高院终审改判陈海鞠有期徒刑13年，剥夺政治权利4年，并处没收财产人民币100万元，受贿违法所得予以追缴。
