　　黄清恒，女，自称1982年2月2日出生，住越南社会主义共和国金瓯省个水县平明社个对宛村，国籍不明。自2010年起，黄清恒在得知广东揭阳等地少数家庭有收养婴儿的愿望后，产生了从越南组织婴儿到广东省揭阳市出卖或组织越南籍孕妇到中国待产，分娩后再将婴儿卖出的犯意。

　　2010年期间，黄清恒经与黄曼丽共谋，两人开始共同实施拐卖婴儿的犯罪行为。2011年，黄清恒、黄曼丽与阮氏军相识后又与其共谋达成拐卖婴幼儿的合意，并逐渐发展了20余人形成一个拐卖儿童的犯罪团伙共同参与犯罪，开始从越南经广西东兴市向中国广东省揭阳市、汕头市等地接送、中转、贩卖儿童，或组织越南籍孕妇到中国待产，产后再将婴儿卖出。

　　2014年5月16日，防城港市中级人民法院以拐卖儿童罪，一审判处被告人黄清恒死刑，并处没收个人全部财产。黄清恒不服，提出上诉。广西壮族自治区高级人民法院依法公开开庭审理，于2015年1月26日裁定驳回上诉，维持原判，并依法报请中国最高人民法院核准。

　　中国最高人民法院认为，被告人黄清恒为牟取非法利益，伙同他人联系、中转、贩卖多名婴儿，其行为已构成拐卖儿童罪。黄清恒提出犯意，多次组织人员自越南将婴儿运送至中国境内贩卖或安排待产妇到中国生产后贩卖，指挥同案被告人在中国境内的接应活动，确定婴儿的贩卖价格，在共同犯罪中起主要作用，系主犯。黄清恒拐卖婴幼儿16起22人，其中12名婴儿下落不明，情节特别严重，社会危害性极大，应依法惩处。

　　据此，中国最高人民法院核准对被告人黄清恒以拐卖儿童罪判处死刑，并处没收个人全部财产的刑事判决。（完）
