　　村官竞选失利 高价雇凶绑架

　　这起非法拘禁杀人案，竟是因广州市白云区鸦岗村村长选举而起。萧裕超今年3月满52岁，本科学历，广州市白云区人。据公开资料显示，萧裕超早年曾当过老师，后在白云区鸦岗村任村官，比他小12岁的被害人邓杰兴曾是他的手下。

　　据法院查明，萧裕超因与邓杰兴竞争广州白云区鸦岗村村长落选，心存怨恨，自2012年9月开始，萧裕超共计出资人民币约80万元找被告人张超明帮忙联系上级纪检监察部门企图由张查处邓杰兴，未果。萧裕超对张超明多番埋怨，要求张超明兑现承诺。

　　萧裕超、张超明遂商议找人以冒充外省公安机关查案等方式拘禁、处置邓杰兴，萧裕超还向张超明提供了邓杰兴及其女友朱某某的具体信息。

　　经过

　　第一次绑人 未果

　　2014年9月初，张超明通过被告人罗志强，找到被告人郑展江，共同商议决定，由张超明出资70万元，郑展江找帮手，负责处置邓杰兴。随后，张超明带郑展江、罗志强去到邓杰兴居住的广州市花都区某楼盘某栋地下停车场，熟悉现场。

　　郑展江回到广西后，将劫持邓杰兴的计划告知其女友被告人陈晓燕，陈晓燕答应帮忙；郑展江又通过被告人韦其湖，找到被告人郑锡桂、韦振增及同案人韦世远（另案处理）帮忙劫持邓杰兴。

　　2014年10月10日，郑展江、陈晓燕分别开着陈晓燕事先租来的商务车、小汽车从广西南宁出发，在横县接上韦其湖、郑锡桂、韦振增及同案人韦世远，携带辣椒水、手铐、刀、塑料胶纸等作案工具，前往广州市花都区。

　　当日20时许到达花都某楼盘附近，由韦振增将商务车换上一副假车牌，再去某楼盘G栋地下停车场守候。22时许，郑展江去到广州市花都区某酒店向张超明要了两个红包（一个内装3600元、一个内装1380元），后因邓杰兴提前回家，劫持未果。

　　第二次绑人 灭口

　　2014年10月11日，郑展江等人换乘另一辆小汽车准备继续去花都区实施第二次劫持行动。出发前，郑锡桂及韦世远退出，韦其湖叫来袁大厅、黎钊加入。

　　当日21时许，郑展江、韦其湖、韦振增、袁大厅、黎钊先去到广州市花都区某楼盘地下停车场守候，陈晓燕则在小区门口看风、等候。

　　23时许，邓杰兴回到地下停车场停好车，走去电梯间时，埋伏在此的韦其湖即持辣椒水喷邓杰兴，袁大厅持刀上前威胁邓杰兴，韦振增用手铐反铐被害人邓杰兴双手，后由黎钊协助，共同将邓杰兴拉入商务车内，迅速离开现场。

　　韦其湖用一件黑色长袖衬衣包裹邓杰兴头部后，再用透明塑料胶纸捆绑严实，当车开到顺德辖区内一大桥上，郑展江、韦其湖、韦振增合力将邓杰兴抛入顺德区杏坛镇一河内。张超明则叫朋友在开平市某路口给了郑展江4万元。事后，郑展江与罗志强一同去到广州，要求张超明支付剩余酬金，因萧裕超未支付酬劳，导致郑展江一直未能收取剩余酬金。

　　2014年10月14日，群众在佛山市顺德区杏坛镇北水堤围河段发现邓杰兴的尸体。经法医鉴定，邓杰兴是机械性窒息死亡。2014年10月30日，韦振增向公安机关投案自首。

　　判决

　　三人被判死刑

　　经两次庭审，昨日上午，10名涉案人员再次出现在广州中院第二法庭被告席上。

　　法院认为，萧裕超为了打击报复，出资由张超明纠集被告人罗志强、郑展江、陈晓燕、韦其湖、韦振增、袁大厅、黎钊、郑锡桂，共同以暴力方法挟持被害人邓杰兴；在组织、实施挟持的过程中，郑展江、韦其湖、张超明、韦振增、罗志强经通谋后合伙杀害了邓杰兴。

　　根据口供，张超明在与罗志强和郑展江商议时，就曾提议过杀人，具有杀人同谋。动机上，张超明收下萧裕超的巨额现金，却一直没办法“整倒”邓杰兴，不仅担心身份败露，还一直受到萧裕超施加的压力；另外，劫持邓杰兴后，若事后邓仍活着，他也难逃刑事责任。

　　张超明杀人动机明确，且在杀人行动中提供帮助，在杀人行为完成后还支付过酬金，已构成故意杀人罪。

　　针对萧裕超及其辩护人提出的其行为不构成非法拘禁的意见，法院认为，根据现有证据，足以证明萧裕超主观上具有限制邓的意图，并在实际行动中指示、纵容罗志强和郑展江等人劫持拘禁邓杰兴。

　　法院指出，二人在案发前就因村长选举产生矛盾，后萧裕超在村中建加油站的事宜，也受到邓杰兴的阻挠；萧裕超为报复邓杰兴，还向张超明支付巨款，以举报贪污为名，行打击报复之实。

　　萧裕超和张超明两人商定，以江西民警办案为由劫持邓杰兴。法院认为，萧裕超具有本科学历，又曾任村官，不可能不清楚纪委查案的正常程序，在明知张超明身份为假的情况下，仍支持其犯罪，非法拘禁罪名明确。

　　因此，郑展江、韦其湖、张超明、韦振增、罗志强犯故意杀人罪，判处死刑或有期徒刑12年、15年不等；萧裕超、陈晓燕、袁大厅、黎钊、郑锡桂犯非法拘禁罪，判处有期徒刑15年至4年不等。其中郑展江、韦其湖、张超明被判死刑；萧裕超则被判有期徒刑15年。
