瓜子二手车直卖网（以下称“瓜子二手车”）在其官网宣称为消费者提供“259项专业检测”，确保平台所售二手车车况合格。然而，消费者孙先生在该平台购买了一辆里程9000公里的“准新车”，却遭遇了里程造假，实际公里数已经达5万多公里，而且存在发动机异响、油耗居高不下、定速巡航故障等多项问题。当消费者向瓜子二手车维权时，该平台却将责任全部推给了原车主，拒绝了消费者的合理诉求。
今年7月，广东省消委会共接待来访、接受投诉咨询1498人次，其中接到消费者投诉598件，与去年同期相比分别增长23.4%，74.3%。互联网服务、家用电子电器、日用商品类居投诉榜前三位。
“准新车”竟是非法专车
消费者孙先生在瓜子二手车直卖网广州分公司购买了2015款北汽绅宝D50自动标准版二手车一辆。
孙先生买车时，网站标注该车为：准新车，2015年上牌，里程9000公里。不过，孙先生在使用过程中发现车辆存在诸多问题：发动机异响，油耗居高不下（1.5L排量油耗11.5L/百公里），并且在高速上110公里时速巡航下，变速箱突发故障，急速降至60公里/每小时，险些造成后车追尾。
行驶不到1万公里的准新车怎么会出这么多问题？带着疑惑，孙先生将车开至北汽绅宝4S店检测，检测结果令人吃惊。维修保养记录显示，该车在2016年4月15日最后一次保养里程为54294公里，里程表竟被人为篡改！更严重的是，孙先生后来得知，此车一直作为非法专车高强度使用。
“篡改里程”网站不负责
孙先生立即与瓜子二手车直卖网售后交涉。然而瓜子二手车的态度与购车时截然相反，瓜子二手车明确表示不负责，要消费者直接和原车主交涉。然而原车主完全不予理会，直接要求孙先生将车退给瓜子二手车。维权却遭遇网购平台和车主“踢皮球”，孙先生无奈向广东省消委会投诉，要求“退一赔三”。
省消委会介入瓜子二手车承认里程造假
省消委会接诉后，马上与瓜子二手车取得联系。对方表示，现在能确定原车主确实动手脚调了里程表，关于这一点，公司愿意承担相应责任，即免去当时孙先生购车的手续费和免费给孙先生的车做一次保养（约3000元）。至于消费者“退一赔三”的诉求，该公司明确表示拒绝。

随后省消委会工作人员多次与瓜子二手车沟通，对方还是认为主要责任在于原车主。
省消委会：网购平台应先赔偿消费者
省消委会相关负责人表示，消费者和瓜子二手车直卖网是委托人和居间人的关系。
瓜子二手车直卖网在其官网宣称为消费者提供“259项专业检测”，确保平台所售二手车车况合格。但众所周知，车辆里程数是评估二手车车况及价值的重要指标，瓜子二手车直卖网宣称的“专业检测流程及团队”却未能发现本案中车辆里程表被人为篡改的事实，为消费者提供了虚假的消费信息，侵犯了消费者的知情权和公平交易权。因此，消费者提出的“瓜子二手车退赔1.5万元的交易差价，并给汽车做一次大保养”的维权诉求合理。
同时，根据《消费者权益保护法》第四十四条第二款规定：“网络交易平台提供者明知或者应知销售者或者服务者利用其平台侵害消费者合法权益，未采取必要措施的，依法与该销售者或者服务者承担连带责任。”瓜子二手车在本案中未履行应尽义务，故不应将责任完全推卸给二手车原车主，而应切实承担起作为第三方网络交易平台的法律责任。此外，根据《消费者权益保护法》第四十四条有关规定，瓜子二手车有权在提供先行赔偿后，向二手车原车主追偿。
