据了解，商家为了促进产品销量，将一部分利润分给推广者，推广者又将部分利润返还给消费者，即为返利网站。作为导购平台，返利网站按销量分成的方式向商家收取佣金。

8月12日，在李瑞的介绍下，记者加入“拼返利骗人受害群”，群里有26位成员，其经历和李瑞类似，都是在拼返利网站上进行活动，却没有增加流量；而不同淘宝卖家向平台所交的押金，全部冻结在拼返利平台无法提取，其中，小到几百元，大到上万元，累计金额达到20多万元。

对“新老”客户不同回应

在工信部地址/域名信息备案管理系统对拼返利网站网址进行查询得知，其经营公司为“东莞市君扬网络科技有限公司”；工商公示信息显示，东莞市君扬网络科技有限公司于今年4月成立，其法定代表人为周清春，注册资本为100万元人民币。

8月13日，记者以淘宝卖家身份加“春秋—招商部”的QQ，顺利通过。对方用相似的口气保证：“5天完成300份销量……如果卖不完，剩余的钱可以提现，两天内到账。”当记者反问其官网公告写8月1日暂停所有活动业务时，对方解释：“8月1日当天公司搬迁，现在早已恢复运营。”

而据群里用户反映，至今未听到拼返利活动专员的任何说明，也未取出自己在平台上的押金。

“而且，官网首页上展示的商品，也并非淘宝卖家自己发布，是平台拿卖家商品的链接放到自己网站上，营造出一种运营的假象。”李瑞将自己的发现告诉记者。

记者在其网站随机选取3个商家，通过旺旺对店主进行询问，得到的反馈也均为“未参与拼返利网站上的活动”。

随后，记者向拼返利网站上仅有的联系方式——客服邮箱发去采访邮件，截至记者发稿，未收到回复。

北京大悦律师事务所律师梁宏刚提出两种猜想：一是拼返利作为一家刚成立的网站，面对同类型网站的竞争，用低佣金的方式经营，或可能遭遇经营不善的状况；二是由于现在网站获取备案比较容易，也不排除其披着合法的外衣故意进行诈骗的可能性；但鉴于所涉金额不大、公司运营主体仍在，难以认定为刑事诈骗，从受骗的淘宝卖家提供的信息资料来看，该案涉嫌民事欺诈。

“淘宝卖家和拼返利公司之间的推广活动，为两个商事主体之间的交易行为，双方已形成合同关系、契约关系，如果公司违约，淘宝卖家可向法院提起诉讼，并申请财产保全，尽量减少已造成的损失。”梁宏刚表示。

鉴于这样的诉讼纠纷，因受害者与网站经营者不在同一个城市，会面临到维权成本高、周期长、取证难等因素，受害者往往选择忍气吞声、直接放弃。对此，梁宏刚建议，受骗商家可以共同委托律师进行诉讼，将立案和搜集证据等相关诉讼的工作委托律师代理，尽可能降低维权成本。

记者搜索发现，除了卖家的钱被冻结在网站无法进行提取，之前也常有买家反映在返利网站提现困难，必须达到某个周期或者积累够某个金额才可进行提取。

在行业观察家洪仕斌看来，返利网站之所以会“拖延”商家或买家的提现时间，是因为资金沉淀形成的资金池，是返利网站除了收取商家提成外的另一个利润来源。

“但返利网站仅凭返利一项模式是走不长远的，如果商家直接让利给买家，那么，返利的商业模式将变成多余的环节，可谓‘鸡肋’。”洪仕斌认为，除非返利网站已积累到足够的用户量，或许可实现转型。
