那么,该项处罚是否违反了劳动法相关规定?对此,北京市康达律师事务所韩骁律师告诉北青报记者,个人的罚款是劳动法明令禁止的行为,职工可以向劳动监察部门投诉。

韩骁律师解释说,“根据《行政处罚法》第8条规定,罚款是行政处罚的种类之一,只能由行使国家行政权力的行政管理机关或者法律授权行使行政权力的机构行使。而劳动法上的用人单位不是行政执法机关,无权对职工的违法行为进行罚款。”
