女教师患癌症被开除 法院不受理“恢复社保”请求

　　新京报快讯(记者吴为)今年8月14日，因患癌症并发心脏病，32岁的大学英语老师刘伶利死在了甘肃省人民医院的病房里。让刘伶利雪上加霜的，是她患癌之后即遭到工作单位兰州交通大学博文学院的开除，并因此丧失了医保报销待遇。

　　新京报记者今日从刘伶利案件代理律师蔡翔处了解到，二审法院兰州中院支持了刘伶利方面的部分诉讼请求，认定开除违法，但对社保关系的恢复却并未受理。刘伶利母亲刘淑琴告诉新京报记者，校方已发来短信，表示愿意商谈相关赔偿事宜。刘伶利家人是否能获得因违法开除导致医保未报销的赔偿，仍未可知。

　　蔡翔表示，学校开除刘伶利给她造成最大的影响就是医保“断顿”。据刘淑琴介绍，从2014年6月到今年8月刘伶利去世，他们在北京、兰州等地累计花费的诊疗费、药费等超过50万元。

　　目前中国城镇职工医保住院治疗的报销水平在75%左右。“初步估算，刘伶利至少一半以上的医疗费是可以走医保报销的。”蔡翔说。

　　据了解，本案中，一审和二审法院都没有支持刘伶利关于恢复其社保关系的诉讼请求。如果职工遇到此类问题，是否都不能通过司法途径加以解决?

　　专业从事劳动法研究的北京大学法学院教师阎天介绍，中国最高人民法院对于劳动争议有过专门的司法解释，其中明确，因用人单位欠缴、拒缴社会保险费发生的争议，应由社保管理部门解决处理，不应纳入人民法院受案范围。只有对于因用人单位没有为劳动者办理社保手续，且社保经办机构不能补办导致劳动者不能享受社保待遇，要求用人单位赔偿损失的，才属于典型的社保争议纠纷，法院才会受理。

　　“法院系统受理社保纠纷是非常谨慎的。我们每个人都有几项社保，这类纠纷数量庞大。同时社保信息掌握在行政机关手中，行政机关处理这类纠纷会更加容易一些。”阎天表示。
