河南洛宁县人民法院近日公布，王顺喜因行贿罪获刑。据“新华视点”记者了解，目前，收受贿赂的8名司法工作人员中的6人分别受到党纪国法的追究。
“打点”中院4名法官实现异地审判
2011年11月，河南新乡市中级人民法院宣判了一起本不该由该院审理的借贷纠纷案。
这起诉讼标的为8400多万元的民间借贷纠纷案，原告是河南顺天化工科技贸易有限公司总经理王顺喜，被告分别是：中国银河投资管理有限公司、中国银河证券股份有限公司、王学旺。
据调查，这是一场精心设计的异地审判。这起由民间借贷导致的经济纠纷案原本应在上海、北京、郑州法院立案，新乡中院并无管辖权。2009年4月，王顺喜经人介绍认识了时任新乡中院立案二庭庭长的王某丙，王某丙给王顺喜想出一个办法：王顺喜申请新乡暂住证，变通之后，王某丙可借助自己分管的立案庭立案。
2009年4月22日，新乡中院将该案立案，当年5月移交审判庭，由杜某担任审判长、蒋某为主审、梁某为合议庭成员。此后两年，案件一直进展缓慢。2011年6月，王顺喜让其弟王某乙出面，开始“打点关系”。

随后，王某乙、王某丙又邀请新乡中院负责审理这起案件的合议庭法官杜某、蒋某、梁某参加一场饭局，以求得照顾，分别送给他们一张3万元的邮政储蓄银行卡。
“收到储蓄卡第二天，手机上有一条陌生号码发来的短信息，上面写有银行卡的密码。”其中一名法官回忆，“当时心里比较忐忑，过了一段时间才去银行查询，知道有3万元存款。”
此后，立案庭长王某丙又两次收受三张银行卡，合计4.7万余元。
2011年11月16日，新乡市中院作出判决，其中，中国银河投资管理有限公司须在判决生效后十日内向王顺喜返还借款1995万元及利息。判决结果支持了王顺喜的部分诉讼请求。
贿赂省高院、中国最高人民法院公职人员“争夺”案件管辖权
就在新乡中院立案的同时，被告中国银河投资管理有限公司提出了管辖权异议。据了解，根据中国最高人民法院民商事案件立案标准等相关规定，这起诉讼标的为8000余万元的民间借贷纠纷案应由河南省高级人民法院来审理。
2009年8月，新乡中院驳回中国银河投资管理有限公司的管辖权异议。后者又向河南省高院提起上诉，2009年12月又被河南省高院驳回，并维持原裁定。银河投资公司最终向中国最高人民法院申请再审。
在这个过程中，两名法院公职人员进入王顺喜的视线。2012年10月，王顺喜请河南省高级人民法院纪检监察局原副局长李某吃饭，并送给他一张3万元的邮政储蓄银行卡。据李某交代，王顺喜“让我帮忙在河南省高院找相关人员给其活动活动，在案子方面给其帮助”。
另一名法院公职人员是中国最高人民法院环境资源保护庭原内勤魏某。据魏某交待，2012年底，王顺喜在北京一家涮羊肉店请自己吃饭，送给自己两张各1万元、一张3万元的邮政储蓄银行卡，希望帮忙协调让案件继续由新乡中院管辖。
收钱后，魏某找到中国最高人民法院主办该案的法官为王顺喜提供帮助，得到的答复是：“这个案子按照标的应当由河南高院立案。”随后魏某将这个结果告诉了王顺喜。
中国最高人民法院再审裁定，分别撤销新乡中院、河南省高院关于这起案件管辖异议的裁定书，撤销新乡中院关于这起案件的民事判决书，案件由新乡中院移送河南省高院审理。河南省高院于2012年8月受理此案。
讽刺的是，2015年3月，魏某因其他原因“出事”，王顺喜当即将送给他的三张卡以挂失补卡的形式将钱取出。
法院纪检干部帮忙行贿 商人“朋友圈”最终覆灭
围绕这起案件的最后一次行贿，是由时任河南高院纪检监察局副局长的李某亲自出面，行贿对象是河南高院负责这起案件的三名合议庭成员中的两人，包括担任审判长的张某和审判员司某。
据李某供述，他曾多次找张某、司某等人协调关系，让他们给王顺喜的案子给予帮忙照顾。“2013年春节前，王顺喜给了我几张丹尼斯的购物卡，让我代表他表示感谢。于是我给张某、司某每人送了2张面值2000元的丹尼斯购物卡。”事后，审判员司某只承认自己收到了1张2000元的购物卡。
尽管多方“打点”，但河南高院负责这起案件的合议庭成员意见并不一致。李某建议王顺喜撤诉，2013年4月22日，王顺喜申请撤诉；河南高院随后裁定准许撤诉。
在“围猎”司法人员的过程中，王顺喜越陷越深。2015年3月，王顺喜被洛宁县公安局刑事拘留，同年4月被逮捕。洛宁县人民检察院以行贿罪对其进行起诉，同年6月被洛宁县人民法院判处有期徒刑一年六个月，并处罚金30万元。
据记者了解，收受贿赂的几名法官也受到了不同的处理。其中，李某因涉嫌受贿罪，经河南省高级人民法院党组与省纪委研究决定，被移送检察机关立案。根据洛宁县人民法院判决书显示，目前王某丙、魏某、李某三人已被另案处理。
根据新乡市政府官网公布的人事任免通知显示，王顺喜被逮捕半年之后，他曾行贿的新乡中院三名合议庭法官，一人被免去庭长、审判委员会委员职务，两人被免去副庭长职务。
“拥有一支纪律过硬、作风过硬、清正廉洁的司法队伍是确保司法公正的关键。”中国社会科学院廉政研究学者高波表示，在全面依法治国、从严治党的背景下，必须要以“零容忍”的态度查处司法腐败案件，强化对司法工作人员的执纪监督和教育；同时进一步完善公正廉洁司法的制度体系，通过拓宽司法公开渠道、创新司法公开方式，解决影响司法公正和司法廉洁的深层次问题。
