“我已经算比较好的了,群里还有人是交了二三万元的保证金,也是没有退还。”华小姐无奈地说。记者加入了华小姐所说的群,该群成员都是与华小姐情况相似的前国美在线入驻商家,不少来自深圳,约百余人。谢先生表示,他是去年4月申请退店,当时运营人员说他还有一笔订单未完成,但谢先生发现那笔订单并不是自己店里的,再次联系运营人员时,对方再也没有应答。在国美在线的售后群、服务群发言申诉,也被踢出群。

叶先生更是有苦说不出,因所在公司需要拓展销售平台,他去年8月份与国美在线开始合作。事先预交了6000元的平台年费和30000元的保证金,但叶先生没有想到,国美在线会在收到汇款后就没了回复。当他再次联系运营负责人时,被告知当时的对接负责人已离职,此后就是各种踢皮球。由于汇款后还没有签约合同,只有一张汇款凭证的叶先生很难进行投诉和维权,现在他很苦恼。

此外,群里有多名商家表示合同已邮寄给国美在线,因为没有复印和拍照,现在都失去了证据。

国美在线方称已修正合同

记者联系了国美在线运营人员,对方称已离职,不便回答问题。群内商家也纷纷表示国美在线并没有专门负责退店业务的人员。记者因此拨打了国美在线商家入驻平台的电话,对方称并不了解退店退还保证金事宜,但是公司在今年初已经修正了“退店后,3个月后退还保证金”的说法,而是以商家最后一个订单商品质保期结束日期为准。

有商家则表示,在其他电商平台都是3个月退还保证金,按照国美在线的说法,至少需要1年3个月,实在不合理。国美在线的官方页面上确实有相关依据,但华小姐提供的合同页面并没有关于“以最后一个商品质保期为主”的说明。目前,记者联系了已经退款成功的商家,对方表示是2014年7月退店,直到2015年9月才拿到退款,对方的理由不是手续没办好,就是中途换人对接。

律师说

国美在线单方面修改说辞不具备法律效力

记者就此事件联系了广东知名律师金焰,他表示国美在线这种行为属于“耍无赖”,国美在线长期不履行合同,商家有权依法维权。但是保证金额数目并不大,商家很难花更高的成本去起诉。最好就是团结起来维权。再者,合同应当是双方共同签署,国美在线单方面修改说辞并不具备法律效力。
