海口原副市长受贿900万一审获刑11年|海南反腐_新闻资讯

　　新华社海口8月25日专电（记者傅勇涛）记者从海南省人民检察院获悉，海南省第二中级人民法院25日对海口市原副市长李杰受贿案一审公开宣判：以受贿罪判处李杰有期徒刑11年，并处罚金160万元。

　　法庭审理査明，2004年至2015年，李杰利用担任海南省海口市交通局局长、海口市美兰区区长、区委书记等职务便利，收受海南福隆集团有限公司等8单位及陈利等23人给予的财物，共计900万元及鉴定日时价值1.95078万元的黄金两块，其行为已构成受贿罪。

　　此外，法庭审理认为，被告人李杰在收受下属的所谓“拜年红包”，虽然大部分没有明确请托事项，但基于李杰的特殊身份，其收受的地点均在其办公 室，这些“拜年红包”与普通的节日送礼红包性质完全不同，应当认定为受贿犯罪。公诉机关指控李杰犯受贿罪的事实清楚，证据确实充分，指控罪名成立，应予支 持。

　　鉴于被告人李杰有立功情节，认罪态度较好，有坦白情节，且积极退赃，酌情从轻处罚。为此，法庭综合被告人李杰的犯罪事实、性质、情节以及对社会的危害程度，依法作出上述判决。（完）
