京华时报讯(记者杨凤临)昌平区南邵镇北邵洼村原党支部书记李华生伙同无业女子王某，以伪造土地租赁合同并虚构经营事实等手段，骗取518万余元拆迁款。王某从中获得10万元好处费，剩余的拆迁款被李华生用来给儿子买婚房，给举报人封口费等。记者昨日获悉，今年7月26日，市一中院一审以贪污罪判处李华生有期徒刑11年6个月，并处罚金60万元；以贪污罪判处王某有期徒刑3年，缓刑5年，并处罚金10万元。
伪造材料骗拆迁款
现年51岁的李华生，只有初中文化水平，2012年12月24日起开始担任南邵镇北邵洼村党支部书记。现年31岁的女子王某，因业务往来而与李华生相识。
法院审理查明，2013年至2014年间，李华生利用协助南邵镇政府从事北邵洼村拆迁补偿工作的职务便利，通过伪造土地租赁合同、虚构经营事实，骗取国家拆迁补偿资金共计518万余元。其中，王某明知李华生骗取拆迁补偿资金，仍在李华生的指使下，参与伪造土地租赁合同及合作协议书，并以被拆迁人的名义与北京铭嘉房地产开发有限公司(以下简称铭嘉公司)签订《非住宅拆迁补偿协议书》，后分得赃款10万元。
用拆迁款为儿子买婚房
涉案的8亩土地位于北邵洼村村南，2008年村民张某承租了这8亩土地，并与村委会签订了5年合同。2013年初，张某承租的土地面临拆迁，李华生就不想把这块地租给张某了。
李华生说，“因为我和王某熟识，而且作为书记，我能够确保王某听话，就提出让她替我租下这块地，还承诺待拆迁后给她一些好处，王某就同意了。”李华生代表北邵洼村委会与王某签订了土地租赁合同，借王某之手向村里缴纳了涉案土地租金4万元，并找人在这块土地上建了房屋等待拆迁。
为了获得停产停业补偿，李华生又花费40万元使用费，借用其他公司的营业执照，来证明这8亩土地上存在生产经营活动。
在获得518万余元拆迁款后，李华生给了王某10万元好处费，还用100万元给儿子买婚房，15万元给儿媳购买车库，借给朋友50万元。案发后李华生表示，“干了十多年也没有什么钱，家里不富裕”。
违反程序私盖公章
李华生案发缘于举报。之前租涉案地块的张某，得知涉案地块拆迁后向李华生要钱，遭拒绝后，张某多次向纪委写信举报李华生。张某在证言中称，他承租涉案土地，李华生等人在租赁合同上签了字，并盖有北邵洼村民委员会公章。2013年该地拆迁，但补偿款518万余元均给了王某。他多次向昌平区纪委举报后，李华生因为害怕，陆续给了他240万元作为封口费。
王某在法庭上说，她只是在李华生叫她的时候去签了个字，具体的事她不清楚，签署的文件也没认真看过。王某表示，她曾经不想签协议，“但因为他是村支书，我是从外地嫁过来的，我也不敢拒绝。”案发后，在家属的帮助下王某已积极退赔所分得的10万元赃款。
案发后，北邵洼村主任郑某以及负责保管村公章的会计刘某均证明，李华生利用职务便利擅自在伪造的土地租赁合同上加盖公章，未经过村两委商议或村民代表大会决议等程序。
因贪污获刑11年半
法院审理后认为，李华生身为国家工作人员，利用职务便利，伙同王某采用签订虚假合同的手段，骗取国家拆迁资金并非法占有，二被告人的行为均已构成贪污罪。其中李华生系主犯，但到案后认罪、悔罪，且部分赃物已追缴在案，依法对其酌情予从轻处罚。王某为从犯，且当庭如实供述自己的罪行，并在亲属的帮助下退缴所分得的全部违法所得，依法对其减轻处罚，并适用缓刑。
今年7月26日，市一中院作出一审判决，以贪污罪判处李华生有期徒刑11年6个月，并处罚金60万元。以贪污罪判处王某有期徒刑3年，缓刑5年，并处罚金10万元。责令两被告人退赔518万余元，发还铭嘉公司。
