今天上午，记者获悉，教育行业从业人员杨某、徐某等6人因非法获取公民个人信息罪，被海淀法院一审判处有期徒刑一年三个月至有期徒刑六个月、缓刑一年不等的刑期。

案情教育从业人员私售200万学生家长信息

根据检方指控，2011年至2013年间，杨某在海淀区华鹰大厦等地，多次利用在培训学校、教育公司工作的便利条件，私自拷贝复制公民个人信息共计200余万条。同时间段内，徐某则在国防大学附近、华通大厦等地，多次从杨某处购买公民个人信息共计200余万条。

2012年8月至9月间，刘某在苏州街长远天地大厦内，从徐某处购买公民个人信息60余万条。2013年3月，苑某在海淀区苏州街长远天地大厦内，从刘某处拷贝复制公民个人信息50余万条。

2015年2月至3月间，牛某、刘乙共谋购买公民个人信息，并由刘乙在北京体育大学附近，从徐某处购买公民个人信息5万余条。

2014年3月，刘某被公安机关抓获，2014年4月22日，被告人徐某被公安机关抓获，并于当日协助警方抓获杨某；随后又有数人相继落网。2014年10月，最后一名嫌疑人苑某主动向公安机关投案。

2012年，徐某将海淀区172所学校的全部信息，以1200元出售给从事教育行业的刘某，此后徐某朋友苑某从刘某处拷贝了部分个人信息。

另一家教育机构市场部主管刘乙向公司法人代表牛某提出购买学生家长信息用来招生获同意后，花费3500元分两次买到了昌平和朝阳多所学校的学生和家长信息。据了解，6名被告人中，有办英语培训的，也有做体育运动培训的。

判决6人构成非法获取公民个人信息罪

法院审理认为，6被告人非法获取公民个人信息，情节严重，其行为均已构成非法获取公民个人信息罪。

鉴于6被告人到案后能如实供述犯罪事实，认罪、悔罪，且被告人苑某有自首情节，被告人徐某有立功表现，被告人牛某、刘乙系共同犯罪，法院综合考虑以上情节，对6人不同程度地依法从轻处罚。

综上，海淀法院一审以非法获取公民个人信息罪，分别判处杨某有期徒刑一年三个月，徐某有期徒刑一年二个月，缓刑二年，刘某有期徒刑一年，缓刑一年，苑某有期徒刑十个月，缓刑一年，牛某有期徒刑七个月，缓刑一年，刘乙有期徒刑六个月，缓刑一年；并各处一万五至五千元不等的罚金。
