　　大众网济南8月26日讯今天上午10时，泰安市中级人民法院对菏泽市原副市长刘国生受贿一案进行了公开宣判。

　　经审理查明，2007年至2014年，被告人刘国生利用担任山东省郓城县县委书记、菏泽市副市长的职务便利，为相关公司或人员在办理用地手续、承揽公务接待业务、争取招商引资项目扶持资金、承揽道路绿化工程等方面谋取利益，向他人索取、非法收受现金、购物卡，共计人民币210万元。

　　法院认为，被告人刘国生身为国家工作人员，利用职务上的便利，索取或者非法收受他人财物，为他人谋取利益，数额巨大，其行为已构成受贿罪。刘国生具有坦白情节，认罪态度较好，有悔罪表现，其亲属自愿退赃，可依法对其从轻处罚。根据被告人刘国生犯罪的事实、性质、情节及对社会的危害程度，以被告人刘国生犯受贿罪，判处有期徒刑八年，并处罚金人民币六十万元。

　　法庭上，检察机关指控刘国生在任郓城县委书记、菏泽市副市长期间，利用职务之便为他人谋取利益，前后50次涉嫌收受或索取他人钱物合计人民币210万元。刘国生和辩护人对其中的48次受贿指控均表示属实，没有提出异议。仅对2次受贿提出了异议，一个涉及法律适用问题，一个涉及证据效力问题。

　　根据指控，自2007年至案发前夕，几乎每年中秋春节，刘国生都会在家里“准时”收钱，少则两千元，多则一万元，前后共计42次，占全部被指控犯罪事实的八成多。

　　在对刘国生涉嫌受贿的全部指控中，100万是其中最大一笔金额。起诉书显示，2010年12月，刘国生向当地企业家杨某索取100万元，同时安排杨某将这笔钱直接支付给了一位曾姓上访人，以平息其对刘国生本人的持续上访、举报。检察机关认为，刘国生的行为属于索贿，依法应当从重处罚。（大众网—山东24小时记者 马俊骥）
