欧美国家:手机禁用直到2013年开放

欧美国家开放飞机的“手机禁令”经历了漫长的过程。航空通信研究者谢鹰介绍,1958年,美国联邦航空管理局发现频率调制的无线接收机能对飞机的导航系统造成干扰。最初对于助听器、电子词典这类的电子产品也是禁止的。随着手机产品在上世纪八九十年代的兴起,在飞机飞行中手机是全程被禁止的。

1991年,美国联邦通信委员会认为飞机上使用手机的影响范围比地面手机的影响范围大,机上使用手机的信号会被地面许多基站都收到,对地面网络会造成干扰,也明确了机上手机禁令要求。

随着移动通信的快速发展,各类无线通信技术发展越来越快,飞机制造中也越来越多地考虑如何抵御手机等设备的干扰影响。手机禁令开始逐步松绑。2013年10月31日,美国联邦航空管理局正式发布,取消机上使用手机禁令。随后新加坡、澳大利亚、巴西等国航空管理当局陆续也放开了手机禁令。

航空公司:

中国国内不许开机,国外可用飞行模式

记者探访了包括国航、南航、东航在内的多家航空公司,得到的答案都是一致的:飞机上不许开手机,即使是飞行模式也不行。

对此,国外的各家航空公司的规定却不太一致。大多数航空公司允许在飞行中打开手机,但有的允许发短信、打电话,有的只允许使用飞行模式开机。

新加坡航空说明,在飞行途中使用手机不会对飞机系统造成影响,可以选择航班上的网络连接,甚至可以在滑行、起飞和着陆过程中使用手机。汉莎航空、澳洲航空、南非航空等都规定,可以以“飞行模式”使用手机,但在起飞和降落期间,很多航空公司都要求关闭手机

有的航空公司允许使用手机,但禁止语音或视频通话,比如美联航,日本全日空也有类似规定。英国维珍航空的规定则宽泛一些,“部分机型达到一定高度以上可以开机,开启国际漫游并进行通话和收发短信。”埃及航空同样允许在A330-300机型使用手机通话、收发短信和上网。

专业律师:

没有发生任何手机干扰飞行案例

半个月前,中国民航局公布了民航法修订征求意见稿,这是民航法自从1996年开始实施以来的一次重大修订。对于“手机禁令”,征求意见稿中也明确提出禁止违规使用手机。违反者,可能面临最高五万元的罚款。

北京航空法学会常务副会长兼秘书长张起淮律师认为,此次民航法征求意见稿中关于手机的规定,是相对落后的。

他认为,现阶段手机无线电对航空器飞行的干扰、影响及其程度,已有许多的调查、研究和理论论证。中国民航法对此问题的规定,应该综合其他航空公司、飞机制造商的处理方式,一概地加以禁止和限制是不合理的。

张起淮认为,由于手机使用的无线电与飞机所使用的无线电同属于一个波段,有可能产生谐波干扰。但到目前,没有发生任何一起因为使用手机造成飞机通讯、导航干扰的案例。

航空通讯研究者:

开放禁令是大势所趋

研究者谢鹰介绍,中国国内航线的飞机当中,93%的机型为波音和空客,5%至6%为庞巴迪、巴航,剩下的1%为中国国产客机。从飞机硬件来讲,中国国内航线正在飞行的飞机与欧美发达国家并无差别。也就是说,既然国外已经开放机上使用手机,中国国内航线的飞机也具备同样的硬件条件。

谢鹰说,在美国之后,这两年世界上大部分国家都已经开放了机上使用手机。目前的开放也是有条件的,那就是在飞机行驶中只能用飞行模式,而不能打语音电话,而且一些航空公司要求在起飞和降落阶段不可以使用手机

对于中国国内开放机上使用手机的前景,谢鹰形容,这是“大势所趋”,目前也在行业内征求意见。不过他说,这也不是简单的一放了之,需要相关的政策准备、技术准备。他解释说,开放机上使用手机,不仅仅是用手机看个文章,查个单词,更重要的是用手机上网。从这方面来讲,各个航空公司对于机上WIFI的技术准备,还有很多工作要做。

谢鹰强调,目前征求意见的民用航空法,其实是强调对于“违规使用”的处罚。他说,他支持开放机上使用手机,同时也支持开放后对于“违规使用”的重罚。他认为,严重的危害飞行安全的违规使用手机行为,甚至应该入刑。
