　　陈玲事件并非学历造假个案，此前媒体也作出过相关报道。河北大学副教授、察哈尔学会研究员朱峰在接受中国网记者采访时表示，“虽然都涉及学历造假，但情况各有不同。”

　　2012年，厦门大学医学院基础医学部“闽江学者”特聘教授傅瑾的“哥伦比亚大学博士学位”涉嫌造假，经调查，厦门大学确认其应聘时提供的博士文凭是一份假文凭。

　　朱峰认为，傅瑾的情况属于伪造虚假的个人学历证件或证明信息，在提供虚假信息的情况下形成劳动合同关系，违反了《治安处罚法》《劳动合同法》等的相关规定。

　　教育部于2015年底发布《关于废止和修改部分规章的决定》对《独立学院设置与管理办法》第二十九条第一款修改为，独立学院院长应当具备国家规定的任职条件，年龄不超过70岁，由参与举办独立学院的普通高等学校优先推荐，理事会或者董事会聘任。

　　“其中删除了‘并报审批机关核准’这一句，在客观上放宽了独立学院院长聘任条件，赋予其更大的自主权。”朱峰说。

　　独立学院院长的聘任就目前来看基本有三种情况：多数独立学院院长由母体高校在职人员担任；部分由公办高校的离退休人员担任；少数独立学院院长由投资方符合任职条件的董事长兼任。

　　“陈玲就属于最后一种情况。”朱峰对记者说。

　　据澎湃新闻报道，陈玲的另外一个身份是某公司自然人股东和法定代表人。其在2013年9月出资3600万元，目前仍为该公司的执行董事、经理、总经理，并拥有公司60%的股份。

　　在该公司2013年年度报告中，“投资设立企业或购买股权企业名称”一栏显示为“兰州交通大学博文学院”。

　　朱峰认为，从国家的相关规定来看，“博士学位”并不构成独立学院院长任职的必要条件，陈玲事件的性质要看其与兰州交大之间是否有约定、或者学校是否对二级学院院长任职资格有特定要求。

　　第一种，如果兰州交大对二级学院院长的“博士学位”没有做出特别要求，而陈玲也不存在伪造学位学历证书的情况，仅仅是在公开简历里提供虚假信息，那么就不影响其任职资格，而是在个人品行或道德上存在瑕疵。

　　第二种，同样是对“博士学位”没有要求的情况下，陈玲如果涉嫌伪造学位学历证书，那么这原则上不影响其院长的任职资格，但是却违反了《治安处罚法》等的相关规定。

　　最后一种，若兰州交大对“博士学位”有做出硬性要求，但陈玲不仅是在公开简历里提供虚假信息，而且涉嫌伪造学位学历证书，那么这就会影响其院长的任职资格，并且违反了《治安处罚法》《劳动合同法》等的相关规定。

　　针对学历造假情况，朱峰认为，应完善政府信息公开制度，健全学历的查询体系。此外，还应尽快完善社会征信体系建设。“目前，中国社会诚信体系建设正在加快推进，这种通过制度化的方式将营造‘诚信走遍天下，失信寸步难行’的社会大环境，肯定会对学历造假等不端行为形成威慑。”朱峰说。
