被告人孙凯作为太古街727号仓库的更夫，明知仓库内不得使用电暖器，也明知仓库内存在防火隐患而将电暖器借给谢相元在仓库内使用，最后导致火灾发生，其行为已构成失火罪。
依据上述事实及庭审中经举证、质证的相关证据，道外区法院依法判处被告人谢相元犯失火罪，判处有期徒刑五年；被告人马玉福犯重大劳动安全事故 罪，判处有期徒刑五年；被告人杨家芳犯消防责任事故罪判处有期徒刑四年；被告人郭军犯消防责任事故罪判处有期徒刑三年；被告人戴有才、郝艳华、张振荣犯消 防责任事故罪，分别被判处有期徒刑三年缓刑四年至三年，被告人孙凯犯失火罪，判处有期徒刑二年缓刑二年。
