昨天,有58同城内部人员爆料称,公司内部领导已经口头传达,从9月份起,全体员工要按照“996工作制”来加班,而且公司不会给任何补偿,包括加班餐、晚上打车补贴也没有。由于没有下达正式邮件,只是口头传达,且没有任何的补贴和加班费,此举遭到58同城员工愤怒反对。

现在58同城对此时做出回应,称每年的9、10月份都是平台业务流量的高峰阶段,为了应对这种业务高峰阶段,每年的9、10月份都会有常规性的动员。公司并不会强制要求所有人一定要按照“996”的规定来安排工作,公司倡导各部门不断提升管理能力和工作效率,而不是靠延长工作时间采用“996”的强行规定来管理员工。

据律师介绍,按照劳动法相关规定,在保障劳动者身体健康的条件下,延长工作时间每日不得超过3小时,每月不得超过36小时。在员工存在超时加班的情况下,即使是员工乐意自愿的,企业仍然会存在一定的用工风险,包括劳动监察检查的风险、被通报批评和被罚款的风险、被举报的风险及仲裁和诉讼的风险。
