这一乱象在业内人士看来,或许是网络约车新政较为严苛所致。7月28日,交通运输部正式发布《网络预约出租汽车经营服务管理暂行办法》(以下简称《暂行办法》),对网络约车平台上的车辆和司机的准入规定,在一定程度上减少了网络约车的数量,也使得部分无法进入市场的车辆和司机希望通过非法手段获取准入资质。

网上公开叫卖运输证

除了代办司机资质,不少商家也代办网络约车的运输证。当记者提出11月1日需要当地相关部门的《道路运输证》才能继续在网络约车平台工作时,有商户表示可以通过关系拿到北京网络约车使用的《道路运输证》,价格为200元。

由于电商平台会定期删掉代办网络约车司机资质业务的链接,《中国经营报》记者调查发现,不少相关商家已经转战至微信群和QQ群。记者通过网络约车司机进入一个名为“北京Uber车主群”的微信群。群中除了刷单信息以外,还有代办司机资质的广告,价格在数十元到一百元不等。

除了代办司机资质以外,网络约车的刷单乱象依旧。但因平台补贴减少,滴滴司机小张(化名)向记者表示,刷单现象已经少很多了。记者也发现,电商平台中之前常见的刷单商户几乎没有了,不过在微信群和QQ群中,依旧还有“打针”(刷单的另一称谓)的内容出现。

但Uber的刷单依旧严重。北京Uber用户晓宇(化名)曾向记者抱怨,自己对上个月一单的Uber服务十分不满,其上车后开了不到十米,司机就拒载,还自动扣了晓宇10元钱。随后,晓宇投诉到Uber平台,Uber返还了晓宇的钱。

“不联系用户就直接开始行程,一分钟结束行程,是标准刷单行为。”天津的王玉(化名)在接受记者采访时表示,自己也遭遇过Uber的刷单司机,但因为优惠多,没有花钱所以也就没计较。而另一个Uber用户李建(化名)就没这么走运,其凌晨连续被Uber司机刷单5次,被刷去了53元。

对此,《中国经营报》记者采访了Uber的相关负责人,但截至记者截稿时间,其并未给于相关回复。

不过张旭认为,代办司机资质在之前就有,在政策出现之前,网络约车平台就对上线的车辆和司机有了准入机制,这虽然对专车市场规范有不利影响,不过网络约车平台也将在未来加大力度打击这种行为。

资质受限代办现象频发

“代办司机资质”灰色领域的崛起,在业内人士看来,或许是因为网络约车新政对平台上的车辆司机提出了较高的要求所致。一位不愿具名的业内人士在接受《中国经营报》记者采访时认为,《暂行办法》对网络约车司机准入机制和车辆管理较为严苛,这在一定程度上助长了代办网络约车司机资质现象的气焰。

7月28日发布的《暂行办法》明确规定,车辆需符合一定条件(如车辆技术性能符合运营安全相关标准要求等),在公安机关登记为预约出租客运,并取得服务所在地出租汽车行政主管部门发放的《网络预约出租汽车运输证》,即可从事网络约车运营。新规还指出,网络约车行驶里程达到60万公里时强制报废;行驶里程未达到60万公里但使用年限达到8年时,退出网络约车经营。

《暂行办法》也对从事网络约车服务的驾驶员实行许可管理。其表示,私家车转成网络约车,要取得运营资质和网络约车驾驶员资格。准入条件为:驾驶员应当符合取得相应准驾车型机动车驾驶证并具有3年以上驾驶经历、最近连续3个记分周期内没有记满12分记录、无暴力犯罪记录。

当年网络约车平台市场野蛮生长,对车辆和司机的准入门槛都非常低。而《暂行办法》对车辆和司机准入门槛的设置对专车平台和司机来说并不是一个利好的消息。

上述业内人士表示,一方面,光是让车辆安装具有行驶记录功能的车辆卫星定位装置、应急报警装置以及接单前必须获取《网络预约出租汽车运输证》资格这两项就会使得Uber平台上长尾的、偶尔会接一两单的、兼职性质的车辆和司机望而生畏,而车辆性质的改变以及报废年限和里程的限制,更是让那些曲线中部的车主变得犹豫。

至于专车驾驶员必须取得相应准驾车型机动车驾驶证,并具有3年以上驾驶经历这一条规定,将会让平台上所有3年以下的,专职的、还是兼职的司机都被排除在专车司机之外。

政策或先紧后松

尽管有不如人意的地方,但随着11月1日网络约车的相关暂行办法和指导意见的试行,网络约车的合法性也被承认。在此节点,其首要任务,便是从扩张市场变为适应政策。

其实在《暂行办法》出台之后,各个地区政府与网络约车平台之间便摩擦不断,互相试探。

由于《暂行办法》中表示,“具体的实施细则由地方交管部门进行制定”,这让当地政府政策的制定有了一个宽松的环境,但业内人士表示,目前部分地方出台的意见办法“扬短避长”,不利于网络约车平台的发展。

不过,一位不愿具名的业内人士在接受《中国经营报》记者采访时认为,虽然从目前来看,部分地区对网络约车平台的规定比较严苛,但不排除未来正式公布的办法相对宽松。

公开资料显示,在网络约车新政公布十天后,兰州便公布了地方版细则,其中争议较大的是,网络约车数量明确在3000辆左右。按照兰州市城市交通运输管理处处长张建彪的说法,这是经过测算后适合兰州本地情况的。

“根据业界通用算法,出租车规模应占城市人口比例的千分之三,兰州常住人口三百多万,一百多万的流动人口,这样算,传统出租车加网络约车需要15000辆左右。按照计划,明年传统出租车将增加到11000辆左右,留给网络约车的指标就不是很多。价格方面,没有上限和下限肯定就乱了。所以要制定一个适合兰州市的合理价格,在幅度范围之内可以市场调节。”

张旭认为,地区政府严格限制网络约车的数量,将使之失去数量优势;抬高准入门槛,出台繁琐的规则,制定严苛的管制措施。这使得网络约车失去其灵活性和多样性。如此管理,其长处将难以发挥,短处反而会凸显,网络约车可能成为“出租车第二”,失去了其存在的市场价值和优势。

不过,一位不愿具名的业内人士认为,就像《暂行办法》出台前后,政府对网络约车市场的态度不一一样,不排除各地政府出台的正式办法会一改对网络约车市场的严苛态度。
