　　中国商务部合作司原司长吴喜林，利用职务便利，在对外经营、承揽业务、为企业减轻事故责任等方面为他人提供帮助，先后收取企业给予的现金、购车款、购房款共计342万元。昨天上午记者获悉，市二中院一审以受贿罪，判处吴喜林有期徒刑10年，并处罚金50万元。

　　现年62岁的吴喜林从上海外国语学院毕业后，进入外经贸部，先后在喀麦隆使馆、卢旺达使馆工作，后担任中国商务部合作司副司长，2005年7月起担任司长，因涉嫌犯受贿罪于2015年3月6日被羁押，同年3月23日被逮捕。

　　法院查明，2005年至2009年间，吴喜林利用担任中国商务部部合作司司长的职务便利，接受安徽某公司副董事长赵某的请托，为赵某的公司在对外经营、承揽业务等事项提供帮助。

　　为此，吴喜林先后收取赵某给予的现金5万元，收取赵某给予的购车款30万元，使用赵某提供的银行卡消费7万元，以借款为名，索取赵某150万元。

　　2005年至2009年间，吴喜林利用担任中国商务部合作司司长的职务便利，接受中国大连某集团公司下属北京某承包有限公司副董事长郑某的请托，为该公司在对外经营、事故处理等事项中提供帮助。为此，吴喜林收受郑某给予的现金150万元。

　　据了解，当初北京市二分检指控吴喜林受贿的金额为387万元，比法院认定的342万元多了45万元。检方指控吴喜林曾以明显低于市场价格向大连国际集团购买房屋，因证据不足，最终法院没有认定这项指控。

　　法院审理认为，吴喜林身为国家工作人员，利用职务上的便利，为他人谋取利益，索取或非法收受他人财物，其行为已构成受贿罪，且受贿数额特别巨大，依法应予惩处。市二中院一审判决，以受贿罪，判处吴喜林有期徒刑10年，并处罚金50万元。

　　自称买房向某公司借150万未还

　　赵某自2005年成立公司以来，负责公司业务的对外联络和拓展。因公司想开展对外业务，赵某通过他人介绍认识了吴喜林。

　　在吴喜林的介绍下，赵某的公司和中国某对外公司在老挝的一个输变电项目中就电缆类产品供应做成了业务，合同金额在1000万元左右。后来，赵某公司在国外一火电站项目二期招投标时，没能进入名单，又在吴喜林的帮助下，最终赵某公司成功获得了该项目的一部分业务。

　　赵某称，吴喜林作为合作司司长，对有对外业务的企业有很大的影响力，给吴喜林这些款物，就是想能够和他维持好的关系，希望能够帮他的公司促成业务。

　　赵某称，2009年9月，吴喜林即将出国前说家里买房需要用钱，想从赵某这里凑点，并提到大概需要150万元。随后，赵某转了150万元到吴喜林指定的账户上。

　　过了一段时间，吴喜林让赵某来到家里，说想就那笔150万元打一张借条。借条上写的是借款人民币150万元，两年内还清。赵某称，借条上“无利息”三个字是吴喜林让其写的。但吴喜林一直没有归还这150万元，赵某也没有管对方要过。

　　为企业减轻事故责任后收取现金

　　2008年，郑某的公司在几内亚住宅建设的工程承包项目出现了伤亡事故。中国商务部决定由合作司吴喜林负责主持处理这次事故的相关事宜，并对负有责任的单位进行处理。

　　郑某找到吴喜林，并对吴喜林说希望部里能够做出较轻的处理。吴喜林当时说他肯定会考虑的。中国商务部最终对郑某的公司提出了口头警告，对具体承包相关工程单位通报批评。

　　郑某称，2009年年底，吴喜林确定要去当参赞的时候，跟他聊起来他想在富力城给儿子买一套房子，但是资金比较紧张。为了感谢吴喜林在几内亚项目的帮助，所以想表示下。

　　吴喜林供述称，合作司对这次事故的处理结果有草拟处理结果的权力，他答应郑某之后，合作司最后草拟给予通报处分的决定，后该处理决定被中国商务部批准。过了一段时间，郑某公司的司机给他打电话，说郑某给他带了东西，他下楼和司机见面之后，那位司机给了他一个箱子。

　　吴喜林把箱子拿回家之后，发现里面装着现金。此后一两个月内，那名司机又通过同样的方法给他送过一到两个装有现金的箱子。现金共150万元，用于他个人开销及购买房子。
