　　司长退休后出事了。

　　政知道说的是中国商务部合作司原司长吴喜林，今年62岁的他因为受贿300多万元，被北京市二中院一审判处有期徒刑10年,并处罚金50万元。

　　虽然到退休时，吴喜林前后有二十多年工龄，而法院认定其出问题的，则仅是其中的四年。

　　这四年，当时人们应该都称他为“吴司长”。

　　部委走出去的外交官

　　一名和吴喜林有过接触的人士告诉说，吴喜林给人的印象是，人低调、务实、平和，“没有一点官架子”。而且工作能力也比较强，深得领导信任。

　　今年62岁的吴喜林1977年从上海外国语学院毕业后进入外经贸部，先后在驻喀麦隆大使馆、驻卢旺达大使馆工作。

　　2003年，根据中国国务院机构改革方案，原国家经济贸易委员会内负责贸易的部门和原对外贸易经济合作部合并成中国商务部，统一负责国内外经贸事务。

　　两年之后，吴喜林成为中国商务部合作司司长。

　　政知道查询发现，2010年2月，吴喜林的头衔换成了中国驻瑞士大使馆经商参赞，之后的2011年4月，时年57岁的吴喜林，又以中国驻法国大使馆经济商务处公使级参赞的身份亮相公众视野。

　　2015年3月，吴喜林因涉嫌受贿被立案侦查。其时，他的身份是中国商务部驻法国使馆公使衔商务参赞(正局级)，在被带走调查前，已届退休之龄。

　　不寻常的领导亲戚

　　法院查明，2005年至2009年间，吴喜林利用担任中国商务部合作司司长的职务便利，接受安徽某股份公司副董事长、安徽某公司董事长赵某的请托，为上述公司对外经营、承揽业务等事项提供帮助，为此先后收取赵某给予的现金人民币5万元，收取赵某给予的购车款人民币30万元，使用赵某提供的银行卡消费人民币7万元，以借款为名，索取赵某人民币150万元。

　　换句话说，吴司长与赵某前后有过四次金钱往来。

　　往来有个前提，就是赵某和他的公司要让司长看得上。

　　吴喜林称，他通过接触了解到赵某的公司在安徽当地有一定的规模，公司产品质量也比较上乘。在这种情况下，他向一些企业推荐过赵某公司的产品，在向企业介绍时，他一般说赵某是他的亲戚，并且对企业强调，希望在价格合理、质量过关的前提下，能够优先选择赵某公司的产品。

　　赵某称，他们公司的对外业务基本都是通过吴喜林介绍的，通过吴喜林的介绍，他们公司和中国某对外公司在老挝的一个输变电项目中就电缆类产品供应做成了业务，合同金额在1000多万左右，合同的内容就是由他们向某对外公司在老挝的项目供应电缆类产品。

　　司长的书柜和借条

　　在和吴喜林认识三四个月之后，赵某去了吴喜林的办公室，当时只有吴喜林一个人在。

　　他对吴喜林说“我来看望看望您，给您带了点东西”，然后就把用黑色塑料袋装着的10万元现金放在吴办公室的一个书柜里，吴喜林客气了一下就收下了。

　　大概在2007年左右，因为有一段时间经常加班，单位没有公车保障，有一次他跟赵某说想买一辆轿车，大概30万左右，后赵某给了吴喜林30万元现金，吴喜林的儿子用这笔钱买了一辆车，后将这辆车过户到吴喜林妻子名下。

　　2009年吴喜林出国前，想在富力城买一套房子，但是因为家里经济比较紧张，在跟赵某聊天时他说起这个情况，没多久赵某转给吴喜林150万元， 后两人签下借条，签借条的时候吴喜林的儿子在场。赵某说，吴喜林最后也没有还给他这150万元。

　　赵某称，吴喜林作为合作司司长，对有对外业务的企业有很大的影响力，他之所以给吴喜林这些款物，就是想能够和他维持一个好的关系，希望吴喜林能够帮公司促成业务，并且能够在公司遇到问题的时候，通过他的职权影响力来解决问题。

　　替人消灾的价码

　　政知道注意到，2005年至2009年间，吴喜林利用职务便利，接受中国大连某集团下属北京承包公司副董事长郑某的请托，为该公司在对外经营、事故处理等事项中提供帮助，为此，吴喜林收受郑某给予的现金人民币150万元。

　　吴喜林称，2006年、2007年左右，中非高峰论坛在北京召开，国家要求合作司负责审查对非洲国家提供优惠买方信贷的事宜。为了完成任务，他找了很多有对外业务的公司商谈，其中包括大连某集团，当时看了他们公司的材料，发现他们的项目有优势，中国商务部就把该项目列入了允许申请优惠买方信贷份额的名单内。

　　2008年，这家公司在赤道几内亚承包的一部分住宅建造项目，由于分包商和劳工人员的矛盾，引发了死伤事故。事故发生后，中国商务部决定由合作司负责处理。在这次事故处理过程中，大连某集团负责和合作司联络协调的负责人就是郑某。在处理过程中，郑某找到他，希望让大连某集团只受到通报处分，并表示公司一定会吸取教训。他当时就答应了。因为这次事故是合作司的分管范围，合作司对这次事故的处理结果有草拟处理结果的权力。他答应郑某之后，合作司最后草拟给予大连某集团通报处分的决定。郑某称，对这起事故，中国商务部最终对集团提出了口头警告，对具体承包相关工程的企业通报批评。

　　合作司处理完大连某集团的事故后，郑某主动对吴喜林说想要表示感谢，之后郑某送给吴喜林150万元。这150万元吴喜林都用于个人开销及购买房子了。

　　判10年的理由

　　政知道注意到，在法院审理过程中，吴喜林对检方指控其犯受贿罪没有异议，但辩称他没有索取贿赂；赵某的150万元其打了借条，他本意是打算还的；纪委找他谈话时，仅掌握他向赵某借款150万元的线索，他与赵某的其他经济往来均为主动供述，有自首情节，请求法庭对其从轻处罚。

　　据了解，检方指控吴喜林受贿的金额为387万元，比法院认定的342万元多了45万元。检方指控吴喜林曾以明显低于市场价格向大连某集团购买房屋，但最终法院没有认定这项指控。

　　法院认为，吴喜林身为国家工作人员，利用职务上的便利，为他人谋取利益，索取或非法收受他人财物，其行为已构成受贿罪，且受贿数额特别巨大，依法应予惩处。吴喜林具有索贿情节，应当从重处罚，鉴于其因涉嫌受贿被调查后，能够如实供述自己的主要罪行，积极全部退赃，有悔罪表现，法院在对吴喜林量刑时综合予以考虑。

　　最终二中院一审以受贿罪，判处吴喜林有期徒刑10年，并处罚金50万元。
