商榷函中表示，作为事件真正的主体，魏则西父母直到目前仍未得到一个来自百度方面的合理解释和说法，百度方面的动作更多是在回应相关监管部门，但对于魏则西父母，却没有任何的主动答复和抚慰。

魏则西父母代理律师称：“非常遗憾，直到现在，我们没有看到百度公司和彦宏先生对魏则西父母一方的解决问题的方案和态度，魏则西事件受影响最大的两个个体居然一直被游离在事件之外，百度一个季度砍掉的20个亿，与此相比，是不是矛盾的？逻辑上是不是不通呢？”

该律师希望正式提起法律诉讼前，通过一周时间的商榷，得到百度公司和李彦宏关于魏则西一案中对魏则西家庭的回复和解决方案。

关于解决“魏则西一案”的商榷函

北京百度网讯科技有限公司、百度在线网络技术(北京)有限公司负责人及公司实际控制人李彦宏先生：

你们好！

我是北京腾波律师事务所的宋维强律师，经过魏则西同学的推荐介绍，魏则西的父母找到了我，希望我能从法律上帮助他们。

我设想了很多见到魏则西父母时的情形，当我真正见到他们时，我的内心还是非常的沉重，因为，他们是普普通通中国老百姓的一个缩影，是两个善良的人，是两个刚刚经历了丧子之痛的人，是两个人生已经不再完整，已经不能再像普通人一样继续走完剩余人生的两个人，他们一直在不停的问我，“为什么没有人主动找我们给我们一个说法和答复呢？”

是啊，可能很多人都在纠结于这样一个问题，社会分工不同，角色定位不同，面对同一件事情，站在不同的角度会有不同的解决问题的方式方法，然而，我们始终相信：人，大多数还是善良的，一个伟大的公司，一个伟大的人，责任和情感也是并行不悖的。

思虑再三，还是决定在提起相应法律程序之前，坦诚的向贵公司、向彦宏先生写这封信，去这封信的目的不是为了什么新闻炒作，不是为了在这里追究谁的责任，不是为了义正严词的谈理说教，我只是想把问题摆出来，同贵公司和彦宏先生探讨，有没有解决这个问题的必要？怎么解决这个问题？如果大家可以达成一致意见，是最好的局面，如果不能谈妥，也只好去法院提起诉讼，让法律做最终的裁决。

基于上述认识和理由，我们没有去发一份刻板生硬的律师函，因为我们始终相信，百度公司和彦宏先生是善良的，法律程序始终是解决问题的最后救济途径，除了法律之外，可以有情感和协商。

如果不是一个有爱的公司和有爱的人，百度公司不会走到今天，一个公司存在的价值和意义并不单纯是他赚取了多少利润，资产规模有多少，当一个公司不能满足社会公众的需求和社会发展的潮流时，当社会公众的心理体验由正转负时，他不会走的太远，正如彦宏先生所说“若失去用户支持，百度离破产只有三十天。”

我们理解百度公司此时矛盾的心理，从魏则西事件发生之后，百度公司的几次表态也可以看出，你们最想做的，是厘清责任。毕竟百度公司面对的是千千万万的消费者个体，一旦在魏则西事件中被认定为承担责任，会产生什么样的连锁反应，似乎很难把握和预料，所以，第一时间，贵公司的反应是想谈清楚责任。

责任可以不可以谈清楚先不去讨论，因为这需要复杂的法律程序去进行判断认定，但是有一点，人心向背需要去用实际行动引导，一个公司的社会形象一旦受损，会付出很大的代价去弥补。为什么魏则西事件突然发酵，为什么社会公众将魏则西和百度两个以前毫无关联的名字联系在了一起？去年此时，谁也不会知道魏则西和百度什么关系，然而，今年此刻，提起百度，社会公众自然会想起魏则西，提到魏则西，人们又自然会想到百度。命运的曲折离奇和冥冥之中的因缘际会，让人感慨！

然而，偶然的事件有其必然性，不出魏则西，可能会出王则西、李则西，逃避不是解决问题的办法，勇于面对，解决问题才是发展之道，我们也看到百度公司面对此事件之后的改变措施，彦宏先生近日也公开表态，“因为魏则西事件，百度一个季度砍掉20亿收入。”

但是，离魏则西事件最近的魏则西的两位亲人、两位法律上的魏则西的继承人，他的父母，百度公司却一直没有去真正面对，没有去给他们真正的解决这个问题，他们一直被边缘化，是百度公司和彦宏先生觉得没有面对和解决的必要么？如果是这样，在逻辑关系又怎么能让社会公众信服百度的改变和诚意呢？

我们认为，百度公司基于同中国人民武装警察部队北京市总队第二医院之间存在利益连接，及“谁受益，谁担责”的民事责任原则，贵公司同中国人民武装警察部队北京市总队第二医院应对魏则西最终死亡的后果承担共同的侵权责任。这个法律问题，如果我们协商不成，相信法院会做出公正的裁判。

但是，现在是不是只有去法院解决这个问题的唯一途径了？是不是魏则西和百度之间一定要先厘清责任再谈其他？

答案似乎不尽然！诉讼毕竟是解决问题的终极手段，解决问题的方法和管道可以有很多种。

这个问题的决定权掌握在百度公司和彦宏先生的手中，魏则西父母同百度公司相比，体量可能显得微不足道，然而，从法律上来讲，魏则西父母和百度公司和彦宏先生却是平等的。

金钱永远不是衡量社会价值和社会存在的唯一标准，企业社会责任也是一个非常大的命题，百度公司和彦宏先生应该比我们更能深刻体会和理解这一点，金钱有时候需要把他作为解决问题的工具。魏则西的父母有正当的职业，还可以过活，虽然晚景凄凉，但是也不至于流落街头，他们因为给魏则西治病所欠的债务，也可以慢慢还清，生活还可以继续，只是，他们唯一的儿子不在了，永远不再了，这种心理的创伤和痛苦单单是金钱又怎么能弥补呢？

非常遗憾，直到现在，我们没有看到百度公司和彦宏先生对魏则西父母一方的解决问题的方案和态度，魏则西事件受影响最大的两个个体居然一直被游离在事件之外，百度一个季度砍掉的20个亿，与此相比，是不是矛盾的？逻辑上是不是不通呢？

因为人们会问：为什么百度可以一个季度砍掉20个亿去应对魏则西事件，却至今没有拿出一分钱去抚慰魏则西的父母？！

是啊，为什么呢？！一个季度砍掉20个亿是不是因为有国家相关部门的监管，是不是你们不得不这么去做？！不去抚慰魏则西的父母，是不是更能表明百度公司和彦宏先生的真正态度？！

对此，我们不想要推导出对百度公司和彦宏先生不利的结论和负面的社会评价，我们期待一个满意的答案。公道自在人心，孰是孰非，自有法律和历史评价，然而，命运，始终还是掌握在我们自己手里。

匆忙之间，写了很多，我此信中的表态也仅作为我同贵公司商榷之用，不产生任何法律上的意义和后果，我们期待百度公司和彦宏先生以事实为依据，以法律为准绳，以人为本，以企业社会责任为纲，积极回应社会关切，妥善处理此事为盼。还是那句话，相信百度公司和彦宏先生是善良的，一个伟大的公司，一个伟大的人，责任和情感是并行不悖的，是一个硬币的两个面。

在去法院提起诉讼之前期待你们的回复以寻求解决问题之道，一周的时间等待应该可以了？
