　　新京报讯 （记者信娜）日前，市城管执法局向组织散发小广告的房地产企业开出40万元罚款，并没收16万张小广告宣传页。记者从市城管执法局了解到，这是迄今为止，北京城管执法部门针对非法小广告开出的最大罚单。

　　售楼处现场发现16万张小广告

　　今年6月初，市民向市城管执法局96310举报，石景山区石景山路有人散发小广告。

　　市城管执法局执法总队解峰及城管执法队员到达现场发现，10余人聚集在古城大街至古城地铁站附近散发房地产小广告。4组8名执法队员，用一个多月实地暗查，拍摄取证，直捣窝点，发现十几万份小广告存放库房。

　　40万罚款据自由裁量权开出

　　市城管执法局执法总队耿硕说，此次罚款40万元，主要依据《北京市市容环境卫生条例》（以下简称《条例》）及《北京市城管执法系统实施行政处罚自由裁量权办法》（以下简称《办法》）规定，根据案件情节，严格按照各项指标系数计算而得出。

　　根据《条例》第四十三条第二款，擅自利用或者组织张贴、涂写、刻画、喷涂、散发标语、宣传品和广告进行宣传的，没收非法财物和违法所得，并处1万元以上10万元以下罚款；情节严重的，处10万元以上50万元以下罚款。

　　耿硕称，情节严重主要考虑散发区域、涉案小广告数量等因素。以此案为例，散发地为长安街延长线，属于一类地区；散发及查扣小广告的数量巨大，因此可按情节严重情况处罚。

　　如何确定具体罚款金额？耿硕介绍，罚款的具体数额可通过自由裁量权确定。2009年，北京各城管执法部门开始试行《办法》，对城管处罚依据加以量化。

　　耿硕解释，罚款金额严格根据不同指标系数，并套用公式进行计算。

　　■ 现场

　　为取证蹲守暗访一个多月

　　整治处罚小广告讲究证据。耿硕说，处罚前，需要搜集足够证据，包括违法人员是否有发放小广告行为，非法小广告印制及发放总量等，如果证据不全面，可能出现违法企业不认账，一问三不知的情况。

　　他回忆，当时现场检查这家房地产企业时，相关负责人对散发小广告和印制存匿小广告拒不承认。但当执法人员将前期摸排得到的证据，如录像、拍照等，摆在其面前时，他们不得不承认。

　　取证过程中，解峰和近10名执法队员，轮流蹲守、暗访，用时一个多月。“天太热了，三十几度的高温，站在太阳下”。解峰笑着指指自己的胳膊，“本来就黑，那段时间后，‘色’更重了”。

　　为防止被警惕性高的散发小广告人员发现，他和同事常便装取证。但取证仍遇到难题。“如果陌生人反复走，或者拿着摄像机到处拍，很容易会被识破”，他说。

　　违法小广告用4辆皮卡拉走

　　摸排后，解峰发现一处隐蔽拍摄取证违法行为的好地方。利用附近一处施工工地围挡，解峰举着摄像机，透过围挡缝隙拍摄。“后面工地在施工，尘土飞扬”，他回忆，“我们站在围挡边，举着摄像机，一站就是一上午”。

　　不只拍摄违法散发行为，执法队员还要“端窝点”，找到存放违法小广告的库房。解峰于是化身为普通的购房消费者。

　　循着广告上的售楼地址，解峰便装与销售人员聊房子。他回忆，自己私下里也做了一些功课。“必须能聊起来，不能一张嘴就是外行”。他前期甚至掌握了附近楼盘房价、户型等信息。

　　近10名执法队员一天天轮流在售楼处与销售人员攀谈。终于在某个下午，售楼处工作人员将十几万张房地产宣传单搬入售楼处内。这一场景被执法人员抓个正着，也成为售楼处作为存匿违法小广告窝点的直接证据。

　　最后，执法队员在现场共发现并暂扣16万张违法小广告宣传页。解峰回忆，16万小广告堆起来像一座小山，“最后我们用4辆皮卡车才拉回局里”。

　　■ 追访

　　房产类小广告连续两年上升

　　2014年，北京一房地产开发公司因在交通枢纽等地散发楼盘广告宣传，被执法部门处罚30万元。这一处罚也成为当年北京城管执法部门对非法小广告案件做出的最高处罚。

　　此次小广告类最大罚单也开给房地产企业。耿硕认为，近几年，楼市逐渐升温，房地产类小广告也开始“抬头”。这成为小广告总量下降中的一个异类。

　　根据城管举报热线96310统计，针对小广告类举报，今年以来稳定退出举报类别的前十位。“这很不容易，和近几年执法部门持续大力整治非法小广告密不可分”，耿硕说，但房产类小广告却在增长。

　　根据统计，2015年，房地产类小广告同比去年增加18%。2016年，又在去年基础上上升12.9%。耿硕认为，房产类小广告反弹，也与行业升温有关。

　　房产小广告升温，执法部门也及时研究对策。耿硕介绍，通过动态分析举报特点，发现房地产类小广告高发。因此决定有针对性地开展重点领域专项执法，如与行业主管部门住建委开展联合执法。

　　房企违规超限可暂停房屋预售资格

　　耿硕解释，一些小案件，执法部门开出的罚单无法对房产企业起到有效震慑作用。但联合行业主管部门，可通过多种手段，如联合执法、约谈、训诫等，发挥更强约束力。

　　这其中，除联合曝光违法企业外，还会将处罚后案件移送住建部门，对企业违法行为进行行业计分。耿硕说，该系统会对房产企业进行计分，如分数累计到一定程度，将暂停其房屋预售资格。“这为执法提供更多抓手”。

　　多措并举，违法散发小广告的房地产企业更愿意配合执法部门，及时整改。耿硕介绍，被处罚的企业也很少出现反弹情况。

　　记者了解到，制定有效的执法措施后，各区城管执法机关也先后查处一批违法企业，例如：东城城管执法监察局对在东直门中学门前组织人员散发宣传品的某公司罚款10万元；大兴城管执法监察局对在大兴区、丰台区多条道路组织人员散发宣传品的某公司罚款10万元。

　　此外，根据统计，截至8月底，今年全市城管执法机关已经共立案处罚非法小广告3763起，罚款236.7万元，收缴非法小广告311.7万张，联合中国公安部门查处非法小广告窝点及储藏点30处；非法小广告警示呼出号码16.3万个，停机1.2万个。
