　　长沙市人民检察院复查认为，被不起诉人王某利用被害人裴裴醉酒昏迷之际与其发生性关系，属于以其他手段强奸妇女，其行为触犯了《中国人民共和国刑 法》第二百三十六条第一款之规定，应当以强奸罪追究刑事责任。本案中，王某对于裴裴案发当日饮酒后发生乙醇中毒身亡的结果不具有应当预见的条件，主观上不 符合过失犯罪的主观要件，王某不构成过失致人死亡罪。故申诉人黄某关于王某构成强奸罪的申诉理由成立，关于王某构成过失致人死亡罪的申诉理由不成立。长沙 县人民检察院对王某作出不起诉决定不当，长沙市人民检察院撤销长沙县人民检察院《不起诉决定书》，由长沙县检察院对被不起诉人王某以强奸罪向长沙县人民法 院提起公诉。（央视记者 赵旭飞）
