　　第一项专门协定

　　中国和加拿大协约签署后，中国外交部条约法律司司长徐宏，曾在媒体撰文对协定进行专门解释，称这是中国就追缴转移到境外的犯罪所得对外缔结的第一项专门协定，是中国深化司法领域国际合作的重要举措。

　　该协定对《中国和加拿大刑事司法协助条约》关于查找、移交赃款赃物的规定进行了细化和补充。协定规定，被非法侵占的财物如能认定合法所有人应予返还，对于没有或无法认定合法所有人的犯罪所得资产，缔约一方可在没收后根据缔约另一方的协助情况按比例分享。

　　据统计，在2015年国际刑警组织中国国家中心局公布的百名“红通”人员中，有40人在美国，26人在加拿大，在加人数排名第二。

　　这26名在加“红通”中，河北省委原书记程维高之子程慕阳备受关注。

　　追逃程慕阳一波三折

　　出生于1969年的程慕阳，原系北方国际广告公司北京分公司经理、香港佳达利投资有限公司董事长。他曾帮助程维高秘书李真转移赃款和勾结他人共同贪污国家资产535万元。

　　2000年8月，程慕阳途经香港逃亡加拿大。此后十几年，程慕阳为了滞留加拿大，曾像赖昌星一样，采取了申请入加拿大籍、申请难民身份、不停打官司等一系列手段，试图最大限度地拖延时间。

　　据媒体报道，2009年，程慕阳申请入加拿大籍未果，就提出了难民申请。从此至今，程慕阳一直在难民申请被驳回、上诉、再度被驳回、再上诉的司法程序中转圈。

　　去年7月16日，加拿大联邦法院法务专员安德鲁·布隆伯格告诉，程慕阳已经在申请难民身份的司法复审中获胜。

　　当时法院法官在裁决书中称：加拿大难民署之前之所以驳回程慕阳的难民申请，原因是程慕阳犯了严重的非政治罪，但程慕阳并未在中国法庭出庭受审。本案的难点在于，难民署驳回申请是有“值得考虑的严重原因”，但这些原因现在仍不清楚，因此判定司法复审成功。

　　除了难民申请，程慕阳还同时在打几个官司。2014年底，他起诉了联邦移民及难民局、联邦边境服务局，理由是“和中方合作分享信息，违反加拿大宪法和国际条约。”

　　北京航空航天大学廉洁研究与教育中心主任任建明曾对说，外逃人员最常用的伎俩就是抓住难民申请等救命稻草，没完没了打官司，通过上诉、败诉、再上诉的漫长的司法程序，最大程度拖延时间。

　　北京外语大学国际关系学院副教授史泽华对说，程慕阳的套路很清晰，利用加拿大诉讼未结不能离境的法律规定，让自己陷入到各种官司中，拖一天算一天。

　　程慕阳和赖昌星在加拿大请的是同一个律师——大卫·马塔斯。据报道，大卫·马塔斯号称从不失手，曾经让几个罪行累累的通缉犯，在加拿大滞留几十年。

　　追逃程慕阳还需要多久？

　　那么，随着此番《中国政府和加拿大关于分享和返还被追缴资产的协定》的签署，已“赖”在加拿大16年之久的程慕阳，被追逃回来的难度有多大？又会耗时多久呢？

　　北京师范大学刑事法律科学研究院国际刑法研究所所长黄风告诉，中国和加拿大双方签署的这个被追缴资产的分享和返还的协议，其前提是对资产进行没收。

　　他表示，不管罪犯是在中国还是在加拿大，其把资产转移到加拿大了，首先需要中国和加拿大双方进行合作，证明这些资产来源是非法的，或者是通过洗钱方式转移的，然后把这些资产先一律没收，之后可以按照这个协议进行分享和返还。

　　黄风告诉，此次签署的协定，和从加拿大追逃像程慕阳这样的罪犯，是两个独立的问题，之间没有关系，追逃还是按照原来的程序走。

　　不过，中国跨国追逃追赃的力度超过以往，加拿大已经不是外逃人员的“避罪天堂”。此番中国和加拿大签署协定，意味着双方的合作更为密切，程慕阳何时追捕回国，只是一个时间问题。
