中国人民大学商法研究所所长刘俊海指出，不管是股权众筹还是债权众筹，在购买人做出购买决定之前，对未来的结果是有明确预期的。而“一元购”这种模式，购买人获得的既不是股权也不是债权，而是中奖机会。所以依然改变不了一元购作为变相博彩商业模式的基本特征。
刘俊海介绍，如果“一元购”平台利用开奖过程的不透明而操纵开奖过程，指定中奖人，就涉嫌欺诈，需要承担相应的刑事责任。
