“领导干部带头生二胎”，中国地方政府稀奇古怪的红头文件
最近，宜昌火了。9月18日，宜昌发布了一则盖了8个公章的红头文件，这则该市8单位发布的公开信呼吁公职人员“从我做起”，要成为“二孩政策”宣传员，引导群众生育二胎。
万万没想到，当年网上流传的“领导干部带头生二胎”的段子，竟然成真了。
对于这一则奇葩红头文件，也引发了网友的热议。 还有哪些奇葩荒诞的红头文件？
什么是红头文件？所谓“红头文件”是指各级政府机关，多指中央一级下发的带有大红字标题和红色印章的文件、声明、公告、公示类等的俗称。是专指行政机关针对不特定的公民和组织而制发的文件，这类文件对公众有约束力、涉及到他们的权利和义务，但并不具备法律的效力。
无独有偶，这些年来，类似的奇葩红头文件还真不少：
连厕所里的苍蝇都要管
2012年5月，北京市市政市容委发布《北京市主要行业公厕管理服务工作标准》。其中规定，公厕内的苍蝇不能超过两个。标准要求：公厕卫生保洁3项控制指标分别为：废弃物不超过两个，废弃物停滞时间不超过30分钟，苍蝇不超过两只。
网友们纷纷挖苦，不超过两只，是不是还要派专人去数啊？ 对此，相关单位表示：并不会派专人去数。

湖北汉川市政府办公室发出了一纸“红头文件”，要求以后全市的公务招待都用小糊涂仙（神）系列酒。据该市一名乡镇干部介绍，要完成市政府办公室下达的两万多元“喝酒任务”，一年下来，除去法定休息日，镇政府平均每天要喝3瓶酒。
这也是醉了……也不知道这背后到底有着什么不可告人的交易……红头文件以文代法、滥用职权 以上那些红头文件最多就是有些荒诞令人捧腹，但下面这些奇葩红头文件就没有那么简单了。
四川眉山一份红头文件让不少人大跌眼镜。这份公函是眉山市委宣传部签发给眉山市东坡区教育局的，上面写着："中共眉山市委宣传部办公室关于XXX就读东坡中学的函"，内容是因该宣传部某职工的孩子今年6月小学已经毕业，准备到东坡中学就读初中，要求东坡区教育局予以妥善安排。这样的公然滥用职权行为也算是一种腐败吧？
红头文件，这些有着红色刊头、盖着政府部门公章的文件，在公众眼中有着极强的权威性和严肃性。然而，现实生活中，类似“虚构”法律法条的各类奇葩红头文件并不少见。
海南省东方市林业局2015年5月针对在该县违规施工的海南某农业公司，以“红头文件”的形式下发了行政处罚通知。作出了让该公司停止施工的行政处罚通知。然而，在这短短200多字的红头文件中，竟然出现了未曾存在的法律和法条。
此红头文件以援引“《中华人民共和国森林法》第六十四条第四款等之规定”。然而《中华人民共和国森林法》，其法律正文只有48条，全文共49条。
近些年来，安徽、山东、内蒙古等10多个地区通过红头文件，关闭地区烟花爆竹企业，造成相关企业较大经济损失。由于文件缺乏相关法律法规依据，今年，安徽省20多家烟花爆竹企业联名状告了省政府。
权力的任性 内容荒诞、低级失误、以文代法等奇葩性红头文件之所以会频频出现，根源大概在于权力的“任性”。
一些政府部门习惯性地把红头文件与法律法规等同起来，在执法过程中有时就会变得随意。不得不说，这些荒诞离奇的红头文件是权力滥用的产物，更是权力为我所用的结晶。
红头文件是机关单位权威的办公文书，有专门的法律法规依据，是政府政令下达的一种方式，更是政府执政理念的一种体现。因此，红头文件，不只是一份简单的通知，更是在向群众表达政府动向，展示政府形象。
就是因为这样的一种规定，让不少人就把这个红头文件给当作是“圣旨”一样的尊崇，所以才会有不少人上当受骗，也是让不少有心计的官员给赚了漏洞。所以为了杜绝此类奇葩性红头文件频频出现，那就是要从根源着手，摒弃“以文代法”的思维，摒弃政府权力的“任性”。
