又一个提供盗版影视作品资源的网站被警方控制。近日，提供非法BT和磁力下载的BT天堂网站负责人袁某飞被江苏淮安警方抓获，引发外界关注。通过观察可以发现，虽然近段时间业内对盗版侵权现象的监管不断收紧，但由于成本低、渠道多，网络上充斥的盗版仍是一个难以根除的毒瘤，时刻影响着产业的良性发展。
监管收紧多个平台被查
“BT天堂也阵亡了吗？”十天前，由于BT天堂无法打开，一位网友在网络平台上发起提问。对于不少人而言，BT天堂并不陌生，是寻找、观看影视作品的主要渠道之一。但是，BT天堂所提供的1万多部国内外影视作品的BT种子和磁力链接均未经授权，侵犯了相关方的著作权。
据警方调查，BT天堂负责人袁某飞从去年6月起，将从网络上采集的影视作品BT种子和磁力链接存储在自己负责经营的BT天堂等三个下载网站，而网民则能免费从该平台上下载，使得该平台流量不断增加，高峰时期日均PV浏览量能达到300万，日均IP访问量达60万，并借此通过广告联盟注册账号，通过投放广告在一年时间内牟利90多万元。
众所周知，现阶段影视产业发展飞速，但提及阳光背后的阴影，利用网盘、盗版资源链接等方式的侵权行为则是插在从业者心中的一根刺。公开资料显示，近年来中国国产电影的盗版损失率已高达55%，每年损失超过10亿元，绝大多数电影在上映后很快就能在网上搜索到盗版资源。
鉴于影视盗版侵权的严重程度，政府、市场等方面均对此加强监管，不仅国家版权局下发了《关于规范网盘服务版权秩序的通知》，今年下半年，国家多部门联合发起打击网络侵权盗版专项行动，突出整治未经授权非法传播网络影视作品（包括使用网络广告联盟等平台）的侵权盗版行为。与此同时，片方加强对盗版侵权的追究，国内主流视频网站也积极采购正版版权，每年的采购成本高达180亿元，从而挤压盗版方的生存空间。经过多方面的共同协作，包括BT天堂、人人影视网、蓝影网等平台均已关闭。
屡禁不止一波刚禁一波又起
包括BT天堂在内的多个侵权平台接连关闭，在一定程度上显示出加强监管网络盗版侵权行为的成效。然而，这些已关闭的网站和平台，只是影视作品侵权大军的一粒沙子，背后还有无数侵权方的存在。
通过观察可以发现，虽然监管愈发严格，但在盗版网站、网盘接连被封后，新的平台又接连设起，并不断地通过微博、微信、论坛等渠道迅速发布消息，其中昨日首日上映的电影《从你的全世界路过》已在当日晚间出现多个“加微信发资源”的帖子。此外，除了部分盗版方是通过用户免费下载增加流量从而吸引广告外，还有盗版方则通过不等的价格售卖盗版资源，比如目前还在院线上映的《追凶者也》被部分盗版方叫价3元。
盗版侵权行为难以遏制，一方面是侵权行为在监管下愈发隐秘和多变，并迅速改换渠道从而达到自己的目的。与此同时，在北京隆安律师事务所创始人徐家力看来，取证难、维权成本太高则成为版权方目前面临的最大问题。有消息显示，今年上映的《北京遇上西雅图之不二情书》也是在首日上映即遭遇盗版，随后版权方寻找偷拍版本流出的影院并决定起诉盗版方，但在距离影片上映4个月后，仍处于取证环节。
值得注意的是，正是因为版权方在取证、诉讼等阶段需要付出较高的时间和资金成本，使得部分版权方选择放弃追究，给了盗版方存活的空间。
打击关键提高惩罚力度
盗版侵权行为给版权方带来的损失并不是小数目，天擎华媒（北京）科技有限公司副总经理孙东亮曾表示，一般盗版侵权行为会使影片流失两成票房，其中最高损失可达四成左右。其中，前段时间上映的电影《微微一笑很倾城》因遭遇盗版侵权，在不到半个月的时间里，其出品方之一华策影视就表示公司损失已有上千万元。在提及如何治理盗版侵权时，很多从业人士纷纷提出应提高惩罚力度，并认为目前对于盗版侵权方的惩罚较轻。
据国家版权局日前公布的2015年度中国打击侵权盗版十大案件，有两件涉及影视作品，即“人人影视网”侵犯影视作品著作权案和江苏“速酷电影”网侵犯影视作品著作权案。而这两件案件的结果分别为“人人影视网”被罚款5万元，并没收主要用于侵权的服务器1台，同时网站负责人主动关闭涉案网站，以及“速酷电影”负责人田某某犯侵犯著作权罪，判处有期徒刑三年六个月，并处罚金70万元，违法所得114万元予以追缴。若以此进行比较，对于盗版侵权方的处罚确实并不算重，所起到的威慑力度也有限。
此外，还有业内人士认为，遏制盗版侵权若仅依靠政府和相关企业，作用仍有限，还有一个关键的角色是观众，如果观众能够对盗版资源说不，则能对侵权方起到较大的打击。
