今年3月13日，巴东县水布垭镇村民谢某在水布垭镇杨柳池社区邮政储蓄银行自动柜员机上取款后，将银行储蓄卡遗忘在自动取款机内。随后，水布垭镇村民谭某前来取款，因其银行储蓄卡无法插入，遂发现自动取款机内遗留有一张银行储蓄卡，且处于取款状态。

见状，谭某试探性地按下取款500元，没想到“哗哗哗”，取款机还真“吐”出了5张百元大钞。

尝到甜头的谭某决定一不做二不休，又四次在自动取款机上取钱，累计取走卡中现金14000元，并将银行储蓄卡拿走。担心事情暴露，谭某随后将银行储蓄卡烧毁。

由于银行ATM机上端都装有监控系统，调出监控视频一看，嫌疑人很快被锁定，谭某的犯罪行为随即败露。今年3月17日，谭某主动将支取的14000元现金上交给公安机关。

巴东县人民法院审理后认为，谭某拾得他人信用卡并使用，数额较大，其行为已构成信用卡诈骗罪。谭某归案后能如实供述自己的罪行，坦白认罪，依法可以从轻处罚。谭某积极退赃，被害人表示谅解，亦可酌情从轻处罚。综上，法院决定对谭某从轻处罚。

同时，谭某犯罪情节较轻、有悔罪表现、没有再犯罪的危险，宣告缓刑对其所居住社区没有重大不良影响，可以宣告缓刑。

法院遂以信用卡诈骗罪，判处谭某拘役5个月，缓刑6个月，并处罚金2万元。目前判决已经生效。
