资料图 邓毅 摄 中新网10月11日电据中国国家发展改革委员会网站消息，近日中国国家发展改革委员会、能源局联合印发《销售电力公司准入与退出管理办法》。《办法》明确了销售电力公司准入门槛，资产总额不得低于2千万元人民币。同时，还明确了应强制退出市场并注销注册的六种情形。
《办法》明确了销售电力公司准入条件。
一是依照《中华人民共和国公司法》登记注册的企业法人。
二是资产总额不得低于2千万元人民币。资产总额在2千万元至1亿元人民币的，可以从事年销售电力量6至30亿千瓦时的销售电力业务。资产总额在1亿元至2亿元人民币的，可以从事年销售电力量30至60亿千瓦时的销售电力业务。资产总额在2亿元人民币以上的，不限制其销售电力量。
三是拥有10名及以上专业人员，掌握电力系统基本技术、经济专业知识，具备电能管理、节能管理、需求侧管理等能力，有三年及以上工作经验。至少拥有一名高级职称和三名中级职称的专业管理人员。
四是应具有与销售电力规模相适应的固定经营场所及电力市场技术支持系统需要的信息系统和客户服务平台，能够满足参加市场交易的报价、信息报送、合同签订、客户服务等功能。
五是无不良信用记录，并按照规定要求做出信用承诺，确保诚实守信经营。
六是法律、法规规定的其他条件。
《办法》提出，销售电力公司有下列情形之一的，应强制退出市场并注销注册：
一是隐瞒有关情况或者以提供虚假申请材料等方式违法违规进入市场，且拒不整改的；
二是严重违反市场交易规则，且拒不整改的；
三是依法被撤销、解散，依法宣告破产、歇业的；
四是企业违反信用承诺且拒不整改或信用评价降低为不适合继续参与市场交易的；
五是被有关部门和社会组织依法依规对其他领域失信行为做出处理，并被纳入严重失信主体“黑名单”的；
六是法律、法规规定的其他情形。
《办法》要求，拥有配电网运营权的销售电力公司申请自愿退出时，应妥善处置配电资产。若无其他公司承担该地区配电业务，由电网企业接收并提供保底供电服务。
《办法》还要求，建立电力行业违法失信行为联合惩戒机制，对纳入涉电严重失信企业黑名单的销售电力公司及负有责任10的法定代表人、自然人股东、其他相关人员(以下简称“当事人”)采取以下惩戒措施：
一是电力交易机构3年内不再受理该企业注册申请，其法定代表人3年内不得担任销售电力公司的法定代表人、董事、监事、高级管理人员。
二是对当事人违法违规有关信息向金融机构提供查询服务，作为融资授信活动中的重要参考因素。
三是限制当事人取得政府资金支持。
四是对当事人申请公开发行企业债券的行为进行限制。
五是工商行政管理、总工会、行业协会等部门和单位在法定代表人任职资格、授予荣誉、评比先进等方面，依法依规对其进行限制。
六是按照相关法律法规进行处罚。
