  但之后三星在全球召回、停售爆炸手机均不包括中国,这种区别对待的政策引发了中国消费者的强烈质疑,在巨大的舆论压力下,10月11日,三星中国公司终于宣布召回在中国大陆地区销售的全部Note7手机。昨天,央视记者对召回落实情况进行了探访。


  三星Note7手机仍在市场售卖 三星客服称无细则无法退换


  10月12日,记者探访发现,仍有商家在售卖三星Note7手机,销售人员表示没有接到相关召回通知,而在这里不仅能买到三星Note7手机,并且价格比专卖店便宜。



  另一路记者在北京望京SOHO的三星服务中心向工作人员咨询已经购买的Note7手机该如何退换时,工作人员要求记者拨打客服电话咨询。而电话客服人员表示,由于召回后退货的具体细则尚未出台,消费者目前还无法退换自己手中的三星Note7手机,目前Note7用户能做的就是等待三星官网的消息。



  中消协提出九项要求:三星不能因缺发票等原因拒退货


  中国消费者协会12日发布消息称,中消协将监督三星公司做好SM-N9300 Galaxy Note7手机召回工作,并提出九项要求:


  一、消费者退机或者换机,三星公司不能以手机有损,包装或附件不全、有损为由拒绝召回。


  二、消费者如持有的合约机,应享有同等的被召回的权利,且三星公司不应在合约机与话费之间的计费标准上做出不利于消费者的规定。


  三、消费者选择退机的,三星公司应在合理期间内提供备用机,供消费者正常使用。


  四、消费者选择退机时,如缺乏发票等凭证,三星公司有义务对应自身销售记录,后台激活记录查询确定,履行召回义务,不得以此为由拒绝退货。


  五、消费者选择换机的,三星公司对其他型号手机的计价应合理,且应在更换时提供全新的三包凭证,对购买凭证(发票等)做出明确有效的更正。三包有效期自更换之日起重新计算。


  六、在消费者退机或换机过程中,三星公司应为消费者提供数据存储转换服务,并做好保密工作。


  七、消费者因配合本次召回所产生的产品邮递费用由三星(中国)投资有限公司承担。有关邮递费用,三星公司应明确有利于消费者的适用方式。


  八、按照《中华人民共和国消费者权益保护法》第二十四条规定,“经营者提供的商品或者服务不符合质量要求的,消费者可以依照国家规定、当事人约定退货……依照前款规定进行退货、更换、修理的,经营者应当承担运输等必要费用。”因此,本次召回中,三星公司所承担的应是运输等必要费用,不应局限于邮递费用。


  九、三星公司应向发生爆炸问题的消费者致歉,并依法赔偿消费者损失。



  央视追问:三星何以漠视、无视、蔑视中国消费者的合法权益?


  在宣布召回和停止销售之后,三星Note7手机在北京市场仍然有售,这都是巨大的安全隐患,三星的这一作法对中国消费者的生命财产安全显然极不负责任;虽然宣布了召回,但对召回细则迟迟不予出台,中国消费者手中的三星Note7手机仍然无法得到顺利退换,往返交通,多次退换不成,这耽误了中国消费者宝贵的时间和金钱。


  三星公司在国际市场的召回行动已经进行了一个月之久,应该有许多召回政策可供借鉴并实施于中国市场,但令人难以理解的是,三星公司在中国市场的召回细则迟迟没有出台,难产背后的原因究竟是什么?


  三星公司是否正在研究专门针对中国消费者的特殊召回政策呢?从全球召回不包括中国,到全球停止销售不包括中国,再到宣布在中国召回之后又迟迟不采取行动,三星公司的这一系列行为,真的是像它的道歉声明中所说的那样,“为中国消费者带来最佳的产品和体验”吗?


  三星在全球实施召回的情况下,当中国消费者的Note7手机发生爆炸三星宣称是外部加热导致,同时表示准备起诉中国消费者;中国消费者的Note7手机接二连三地发生爆炸三星中国公司想到的不是如何解决产品质量问题,而是对多位中国消费者进行威逼利诱,通过退赔补偿的方式,要求中国消费者和他们达成和解,要求中国消费者上缴爆炸手机,要求中国消费者不许在网络上上传爆炸视频。


  三星公司这种欺凌消费者的作法,不仅侵犯了这些遭遇手机爆炸的中国消费者的正当权益,更严重的是,它通过这种方式隐瞒产品质量缺陷,更是把那些手机还没有爆炸的中国消费者的生命财产安全完全不当一回事。
