中国能源局核电司原司长受贿千万获刑12年半 只承认收98万

国家能源局核电司原司长郝卫平

　　北京晨报10月19日消息，曾被戏称为“核电一哥”的国家能源局核电司原司长郝卫平受贿案近日宣判，北京晨报记者昨天获悉，北京市一中院以受贿罪，判处郝卫平有期徒刑12年6个月，并处罚金400万元。

　　“核电一哥”落马

　　郝卫平今年53岁，2004年任电力处处长，2008年国家能源局成立时升为电力司副司长，2012年12月至2013年3月任国家能源局核电司司长。

　　2013年3月，国家能源局与电监会合并成立新能源局，两个月后郝卫平改任新能源局核电司司长。2014年被免去国家能源局核电司司长。因主管中国电力项目的审批，郝卫平被外界称为“核电一哥”。

　　2013年5月，中国国家发展改革委员会原副主任刘铁男被调查。随后一年多内，包括价格司原司长曹长庆、中国国家发展改革委员会能源局原副局长许永盛等在内的多名干部被立案查办，其中就有核电司原司长郝卫平的名字。

　　涉案1200余万元

　　据公诉机关指控，2004年至2012年间，郝卫平利用其担任国家发展和改革委员会能源局电力处处长、国家能源局电力司副司长职务上的便利，为北京三吉利能源股份有限公司、中国华电集团公司、中国大唐集团公司等单位在电力项目审批方面谋取利益，单独或者伙同其妻刘某，非法收受上述单位负责人给予的人民币934万元，美元3.5万元，以及明显低于市场价格购买房屋两套，共计折合人民币1240余万元。

　　庭审否认大部分受贿

　　记者了解到，郝卫平落马后主动交代了侦查机关尚未掌握的涉及800余万元的受贿事实，并如实供述其他受贿事实，还检举揭发国家能源局原副局长许永盛等人。不过在庭审中，郝卫平却对指控的大部分事实均不认可，仅承认收受了98万元。辩护人则认为，郝卫平的行为虽构成受贿罪，但起诉的绝大部分受贿事实均不成立。对此，法院则认为其翻供的理由有悖常理，难以成立。

　　法院认为，郝卫平受贿事实中，绝大部分受贿事实系两个以上行贿人共同向郝卫平行贿，行贿人的证言能够相互印证；或者行贿人虽是一人，但行贿前后曾向上级领导、相关人员汇报、告知给郝卫平送钱，上级领导、相关人员的证言对行贿人的证言予以补强。

　　市一中院经审理认为，郝卫平利用职务上的便利，为他人谋取利益，单独或伙同他人非法收受他人财物，其行为已构成受贿罪。鉴于郝卫平到案后揭发他人犯罪行为，查证属实，系立功；受贿所得赃款已全部追缴、退缴在案；在侦查阶段主动交代了侦查机关尚未掌握的部分受贿事实，依法可对其从轻处罚。据此，法院一审判处郝卫平有期徒刑12年6个月，并处罚金400万元。
