福建高院官微发布的消息称，该院复查该案后认为，原判以走私武器罪，判处原审被告人刘大蔚无期徒刑，量刑明显不当。刘大蔚近亲属的申诉符合重新审判的条件，决定本案由福建高院另行组成合议庭进行再审，择日依法公开开庭审理。
四川少年刘大蔚1996年4月生出生在达州市大竹县。2014年夏天，他通过QQ向台湾卖家网购仿真枪，后被千里迢迢赶来的福建石狮海关缉私分局逮捕。
根据泉州市检察院起诉书，2013年8月，刘大蔚开始通过QQ与台湾卖家商谈购买枪支事宜。2014年7月1日前后，他在台湾卖家提供的网址里选购了24支仿真枪，并将相应的枪支型号发给了台湾卖家。枪支货款和代购服务费共计30540元。
起诉书称，7月22日凌晨，这24支仿真枪被石狮海关缉私分局查获。经鉴定，24支仿真枪支有21支以压缩气体为动力发射弹丸，其中20支具有致伤力，认定为枪支;1支不能确定是否具有致伤力，不能确定是否为枪支。24支中3支不具有致伤力，认定为仿真枪。
2015年4月，福建省泉州市中级人民法院以走私武器罪，判处刘大蔚无期徒刑。当年8月，福建省高级人民法院维持原判。
这起因网购仿真枪获无期徒刑的案件，引发舆论广泛关注。
2015年11月26日，受刘大蔚父母委托，徐昕律师来到福建省高院，递交了申诉的相关材料。其提交的诉状称，“刘大蔚无走私武器的主观故意，更无走私的客观行为;涉案枪形物根本不是刑法上的枪支;刘的行为社会危害性极低，远未达到需以刑法严惩的程度”，建议福建高院启动再审。
