　　浙江在线杭州10月21日讯（浙江在线记者/吴佳蔚 通讯员/李洁 编辑/汪江军）2015年7月4日16时许，位于温岭市大溪镇佛陇工业区的温岭市捷宇鞋材有限公司发生房屋坍塌，造成14人死亡，多人受伤。

　　事发后，由公安、消防、医务人员等社会各界人士组成的500多人救援队迅速赶赴现场施救。整个救援过程持续了47小时，直至最后一名被埋者被寻获。

　　2016年10月21日，温岭法院对该起重大劳动安全事故案一审宣判：公司法定代表人徐福林被判处有期徒刑5年。

　　法院查明：2010年年初至2012年期间，徐福林在未经过审批许可的情况下擅自进行厂房建设，未经勘察和委托设计，自行确定建造形式和结构要求，并为获得发泡机机器冷却和消防用水，未经荷载计算擅自在屋顶建造水池用于蓄水，使厂房建筑存在重大质量安全隐患。

　　事发时，厂房因楼屋面荷载过大，钢结构承载力不足，致使房屋结构体系失稳造成厂房坍塌，致使14人死亡，多人受伤。倒坍厂房价值人民币170.28万元。

　　2015年7月5日日1时许，徐福林主动投案，并如实供述其涉案事实。之后，他积极筹集善后处置款1188.119万元，与被害人或其家属达成了调解协议。

　　2016年4月21日，温岭法院公开开庭审理了此案，徐福林对公诉机关指控的犯罪事实及罪名均无异议，当庭自愿认罪。

　　法院认为，温岭市捷宇鞋材有限公司法定代表人徐福林作为公司直接负责的主管人员，其行为已构成重大劳动安全事故罪。鉴于徐福林案发后自动投案，并如实供述其犯罪事实，系自首，当庭自愿认罪，积极预交赔偿款，决定依法予以从轻处罚，遂作出如上判决。
