24岁的阮先生是绍兴市越城区人，从2013年起，阮先生陆续借给朋友茹某12万元。2014年，茹某向阮先生出具了一份借条，确认借款事实。
自此以后，阮先生向茹某多次催款，茹某却以种种理由拖延。
去年5月20日，茹某主动联系阮先生，约定见面处理借款事宜。第二天晚上8点左右，茹某先归还了一万现金，并要求重写借条。
阮先生没有多想，当即将原先的借条交还，茹某则拿出自带的笔重写了一张借条，按好手印。写完后，茹某随手将笔扔在地上，很快离开现场。
