  据新华社电 记者从深圳市市场和质量监管委了解到,近期引起社会关注的深圳市南山区“6平米售卖88万元”的侨城尚寓项目,经深圳市市场和质量监管委南山局调查取证,其广告词因违反广告法,广告发布主体因此被罚60万元。


  侨城尚寓项目法定名称为“沙河观景阁”,现状为一栋15层高建筑物,建筑功能为办公、公寓。其中6至15层为公寓共169套,权利人均为陈某某等。今年6月,深圳市中执资本投资有限公司和吴某某等4个自然人受陈某某等人委托销售上述公寓,但中执公司称与陈某某等人的关系名为委托实为转让,并提供了部分银行转账凭据。中执公司在对该169套公寓重新装修后再向社会销售。


  “中国空前、深圳绝版、6平米精装极小户型驾到。”随后,深圳侨城尚寓项目打出广告,“6平米售卖88万元”的公寓项目引发关注。


  深圳市市场和质量监管委表示,该项目的“6平米精装极小户”违反《广告法》有关规定,没有标明是建筑还是套内面积;“中国空前、深圳绝版”违反《广告法》第四条,使用无法验证的调查结果作为证明材料,发布虚假广告。


  近期,深圳市市场和质量监管委南山局对广告发布主体下达《行政处罚决定书》,责令当事人停止发布上述违法广告,在相应范围内消除影响,罚款人民币60万元。

  “鸽子房”涉嫌违法改建销售


  “鸽子房”位于深圳南山区,隶属于侨城尚寓,为一栋15层高建筑物,功能为办公和公寓,于1999年取得建设工程规划许可证,2006年规划验收合格,2007年办理了房地产登记。


  据媒体报道,这些“鸽子房”户型售价88万元。面积从5.73平方米到7.48平方米不等,加上开发商赠送的面积,实际使用面积约12平米。且厨房、卫生间一应俱全。销售方对外宣称,开售9套房半天即售罄。此外,该房屋产权为70年,属于标准的限购限贷住宅类产品,每一套都有红本房产证。


  9月26日,深圳市规划和国土资源委员会通报称,“侨城尚寓”项目的11套建筑面积6平方米左右的房型,最终认定为涉嫌违法改建销售,要求对项目占用公摊面积部分采取强制措施恢复原状。与购房者解除买房协议,此外对所涉房地产中介机构严肃查处。


  与此同时,项目方已主动暂停销售行为,承诺与已售出的4套6m2左右房产的买受人解除买卖协议,自行理顺相应经济关系。
