　　中国青年网北京10月31日电（见习记者张瑞宇）不久前，广州17岁少女捐卵一次取卵21颗险丧命的报道，让地下捐卵黑市浮出水面。记者尚未获得地下捐卵机构的相关数据，但据2015年统 计显示，中国不孕不育患者已超过4000万，需要辅助生殖助孕的育龄妇女约有300万左右。国内正规的卵子库远远不能满足需求。

　　地下卵子交易市场有多大？眼下，即便对普通人 来说，联系一家地下捐卵机构也毫不困难。位于北京市海淀区花园路的北医三院生殖医学中心附近，人行道和天桥上“捐卵”、“供卵”、“代孕”的小广告绵延数 百米。在网上，只要检索“捐卵”或“买卵”，也能找到大批中介。一些中介明确出价2万到6万。在北京和上海一些高校的贴吧，记者也发现不少“求爱心捐卵” 的帖子，标示“营养费”1到3万。

　　卵子卖价由捐卵者学历、颜值决定

　　10月17日，中国青年网记者通过QQ检索“捐卵”、“北京”关键词找到三个北京地区捐卵的QQ群，试图加入，但未通过验证。两小时后，网名为“试管生殖中心”的QQ账号发来消息，称其为联系捐卵和买卵客户的中介人员。

　　记者以刚毕业大学生身份表示希望捐卵，按要求提供了一份个人基本信息，包括职业、学历、专业、毕业学校、体重、血型、肤色、脸型、眼睛、例假、五官中最满意地方、特长爱好、性别偏好等。

　　收到记者的个人信息后，中介进一步要求记者发 4张近期照片和学历证明给客户看。中介表示，学历证明会在学信网核实，捐卵者的长相不太重要，客户比较看重学历。此外处女不要，最近服用避孕药的不要，作 息时间不规律的不要，吸烟酗酒者不要。中介提醒，以上几项根据体检都能查出来，希望捐卵者自重。

　　记者提供了某985高校的学历证明，并给出了6万元的“理想价格”。在中介发来的“捐卵注意事项”中写着：“学历不够长相甜美，价格会低；长相不够学历够只能盲捐（盲捐指不见客户，不一对一供卵）。”

　　由于记者填的血型为ab型，中介表示ab血型太稀少，只有夫妻双方中有一方是ab血型或者一方a、一方b的会选择记者做卵源，很多客户还是会嫌麻烦，不予考虑。

　　通常在北京见客户到外地取卵

　　中介向记者表示，安排捐卵者与购卵者见面一般都在捐卵者例假之前一段时间，等双方谈妥，例假来的时候就要开始注射促排药物，持续10到13天直至取卵。

　　对于捐卵体检，其称检查是在正规的门诊，主要针对艾滋病、梅毒、淋病、乙肝等疾病，一项不合格都不行。

　　对于促排的相关操作，其称是“自己的私立医院”在外地，注射促排卵溶液也是医生私自调配的，但并不愿透露医院和溶液的具体情况。并称，促排、取卵的路费要自己出，因为骗子太多，取完卵后才报销。

　　由于促排要去外地医院，记者表示不希望去外地。中介称，北京需要卵子的客户少，希望记者降低价格。并表示一旦找到购卵客户，就安排记者与客户见面。

　　记者问及其他捐卵者，其称很多学生和低收入群体，“因为来钱比较快”，“捐三四次的都有，过三个月就可以捐，但是为了保证质量一般建议过半年再捐”。

　　综合记者的个人情况，以及记者不去外地取卵的要求，双方最终协商5.5万的价格。中介强调说，如果是在正规医院捐卵，价格只有5000元。

　　买卖双方交易后“老死不相往来”

　　三天后，中介安排记者与客户在某酒店见面。女 客户到场后，简单确认了记者的成绩、学历及亲属年龄等信息以后，便要拉记者去附近的家恩德运医院做B超。女客户告诉记者，中介通常有他们自己的私立医院做 排促卵、试管婴儿等，南方很多。但是女客户表示自己不会用中介联系的医院，她会对自己的生命安全着想而选择正规的私立医院。

　　记者询问是否要签协议时，对方回答，如果记者想签是可以的，但是她会要求记者放弃对将来产生的孩子的一切权力。

　　女客户表示，自己年龄太大（近四十岁），做B 超检查卵巢内已经没有卵子了，不能再生育，之前做过两次试管婴儿都未成功，自己有一个7岁的女儿，想再要一个给孩子做伴，并称性别还在考虑。女客户表示， 自己从事IT行业，不会和记者再有交集。此前中介也曾告诉记者，捐卵后会和客户“老死不相往来”。聊天间，女客户给记者看自己的B超检查。

　　关于费用的问题，女客户并不透露自己给了中介 多少钱，也不知道中介给了记者多少钱。客户似乎看出记者比较犹疑，表示见记者前已经见过五六个女孩，而她们只是长得很好但并不合适，“感觉你跟她们不一 样，上过大学嘛，你可以这么想——第一你可以赚笔钱，第二你这样也是帮助了别人，让别人的家庭幸福啊”。

　　律师：买卖卵子构成犯罪

　　10月28日记者就买卖卵子行为咨询了律师。北京春林律师事务所主任庞九林接受采访时称：卫生部发布的《人类辅助生殖技术管理办法》明确规定，禁止以任何形式买卖配子、合子、胚胎。那些中介组织所进行的买卖卵子活动已构成犯罪，相关医疗机构也属非法行医。

　　卫生部2003年修订的《人类辅助生殖技术规范》中明确规定，禁止任何组织和个人以任何形式募集供卵者进行商业化供卵行为。赠卵只限于试管婴儿治疗中的剩余卵子，严禁买卖卵子。

　　中国青年网记者获悉，北京大学第三医院生殖医学中心设有卵子库，咨询中工作人员告诉记者，其卵子库仅用于保存试管婴儿治疗中剩余卵子，并不面向社会募集。

　　记者关注到，曾有律师提出买卖卵子或涉及非法 买卖人体器官罪。另据记者了解，2015年中国两会上，中国人大代表、国鼎律师事务所主任朱列玉提出议案将组织出卖、非法摘取卵子的行为规定为犯罪的议 案。现有法规仅仅对医疗机构的买卖卵子行为规定了处罚办法，但对非医疗机构没有规定任何处罚措施。其议案建议在刑法中设置组织出卖卵子罪、发布买卖卵子广 告罪，以及对未经同意、强迫、欺骗摘取卵子和摘取未成年人卵子的行为，按照故意伤害罪定罪处罚。
