今年7月至10月之间，记者在吕梁、运城等地多次暗访发现，尽管地方政府多年来对土炼油点进行打击取缔，但是受到利益驱使，土炼油点始终难禁，打击风声一过土炼油点就死灰复燃。
10月25日，记者在交城县辛南村一片农田发现多个土炼油炉和一些辅助设备，尽管没有看到炼油人员，但是附近农地几乎寸草不生，空气中弥漫着刺鼻的气味。 不远处的两个高墙院内，记者利用无人机航拍看到院内停放着数辆油罐车，还有不少炼油设备。辛南村村民说，打击风声紧的时候，隐蔽的土炼油点都不敢炼油，可 风声一过简直是“群魔乱舞”。
夏家营镇位于交城县和文水县交界处，土炼油点存在已久，曾发生过多起土炼油产生的有毒气体泄漏致人伤亡事件。今年以来，交城县多次组织进行打击，还制定严 厉打击土炼油点等土小污染企业专项行动工作方案，各乡镇和县专项行动队开展联合执法，出动各部门执法人员，打击取缔包括土炼油点在内的土小企业20家，立 案11起，抓捕24人。
严厉的打击并没有让土炼油点绝迹。今年10月23日，夏家营镇贾家寨发生一起土炼油有毒气体致两人死亡一人重伤事件。记者赶往出事地点看到，一座厂房院内已经搭起了灵棚，院子角落处还能见到油罐，现场帮忙的人们对死者的死因讳莫如深。
据知情人透露，这就是一处土炼油点，如果不是这次出事，平时很难被发现。死亡的是老板侯年林和一名司机常永福，当时两人被炼油散发出的有毒气体呛死。死者常永福亲属告诉记者，该窝点在今年夏季就被执法部门查处，老板还被拘留，但是整顿风声刚过，就又开始炼油。
记者向夏家营镇政府求证，镇长李建忠始终没有露面接受采访，电话一直处于无法接通状态，对于记者短信想了解的情况也没有回复。正在太原培训的夏家营镇政府 党委书记李华斌对这次事件不置可否。他说，土炼油点靠乡镇来打击非常困难。11月3日，记者向交城县宣传部门核实，相关负责人说，具体事故原因警方还在调 查中。
记者调查发现，至今，山西吕梁、运城一带的土炼油点仍在暗中生产。记者在运城稷山县白家庄一家敬老院附近发现两个土炼油点，附近村民对土炼油造成的空气污染苦不堪言。
贪便宜的货车司机、非法炼油点、黑加油站点串起了一条劣质油品的流通黑色“产业链”。在夏家营镇附近的一个面馆，记者看到进门处贴有销售柴油的“好消 息”，该广告称，“供应机炼柴油，纯机油炼制不掺搅”“备有POS机，可刷卡支付”。销售的柴油分为两种，一种是每升2.9元，该广告称这种油大厂生产， “电喷车单烧没问题”；还有一种是每升2.8元，小厂生产，“价格实惠”，“持华鑫拉煤票可随意加油”。
记者在运城、临汾、吕梁等地发现，正规加油站难敌暗藏民宅的“黑作坊”。部分县区国道沿线暗藏多个黑加油点，有的甚至藏身民宅，还有一些私自改装的油罐车随意在路边加油，不仅扰乱成品油市场秩序，而且存在很大的安全隐患。
运城河津市209国道樊村段是当地一条重要的运煤通道，拉煤大货车络绎不绝。记者沿路暗访发现，仅两公里的道路两旁就隐藏着大大小小五个黑加油点。记者在 一家饭店的后院看到了一台加油机和一个巨型油罐。在与一家便利店紧邻的砖房内，一根长长的油管从里面伸出来，加油枪扎进了货车油箱里。
记者以购买大批量柴油为由与正在加油的黑加油点老板攀谈起来。“这油是山东的清洁柴油，每升3块多，比市场上柴油价格便宜1块，我们干这个已经很多年了， 有很多‘回头客’。”这位老板说。距离这家黑加油点不远处，一位住户告诉记者，他家里也能加油，油罐就在自家院子里面，而且“经营”多年都没有事，也不怕 被查处。
运城市民营加油站协会的一位知情人告诉记者，仅河津市樊村镇估计就有六七个黑加油点，卖的柴油大多数来自废机油、煤焦油提炼，这些土炼油点的柴油通过个人收购，最终流向没有任何手续的黑加油点。
10月8日晚间，记者跟随一辆河北牌照（冀JM1255）的大货车，来到吕梁汾阳市东庄村的一个黑加油点，卷闸门背后隐藏着三台加油机。大货车加油后驶离，加油员侯根青辩称，刚才是给自家大车加油，但对于记者询问的车牌号、货车去向，他声称“都不知道”。
村民守着“炸弹”过日子
空气、水源、土地被污染
土炼油在生产过程中会产生大量有毒、有害气体，还会对土地、水源造成毁灭性破坏，严重影响周边居民的身心健康。很多村民反映，“到了深夜都能把人呛醒”。黑加油点的油罐多放置在简易搭建的房屋内或埋在地下，犹如“定时炸弹”，一旦发生火灾，后果不堪设想。
在夏家营镇的大辛村和贾家寨一条穿村而过的河流旁，记者看到河面飘着油污，村民说，这就是土炼油点往河里倾倒的废物。尤其到了深夜，土炼油点趁着夜色偷偷 炼油，非常呛人。吕梁一位曾经举报土炼油点的村民说，尽管曾受到土炼油点老板威胁还被打伤住院，但他还会向有关部门反映真实情况，拿他的话说，“被打死也比呛死强”。
黑柴油流向非正规加油点后，存放条件不达标安全隐患极大，无异于一颗“定时炸弹”。运城河津市民营加油站协会吴璇说，正规加油站内的建筑要达到一定的耐火 等级，黑加油点的建筑根本不达标。此外，正规加油站的开关、电线、电灯等都是防爆设备，而黑加油点几乎都不会安装任何防爆设施。运城等地的一些村民告诉记 者，黑加油点隐藏在居住区，就像守着“炸弹”过日子。
临汾侯马市晋都路一家中石油加油站站长说，时不时会见到黑加油车停在附近给来往大货车加油。这些黑加油车所售柴油几乎都是劣质油品，由于价格低吸引了很多 大货车排队加油。运城、临汾部分正规加油站负责人告诉记者，黑加油车多由报废车改装，加油阀门和电路也是私自安装，其中一些车辆还伪装成洒水车，在国道沿 线随意停车加油，一旦出事后果不堪设想。
据不完全统计，山西各地的黑加油点、黑加油车约有700多个。山西一家环保公司负责人告诉记者，由于进货渠道不正规，且质量未经检验，黑加油点油质普遍较 差。黑加油点滋生大量移动的污染，这些废机油中含有致癌、致突变、致畸形物质及废酸、重金属等物质，难以自然分解，严重污染环境。襄汾县古城镇中石化加油 站工作人员说，“黑油”品质特别次，加这种油的大货车会冒大量黑烟，车也特别脏。
违法成本远低于巨额利润
监管面临“割韭菜困局”
基层相关人士认为，当前对土炼油点、黑加油点、黑加油车的打击陷入“割韭菜困局”，尽管相关部门每年都打击处理，但土炼油点、黑加油点、黑加油车却屡禁不绝。受访人士认为，亟待构建群众监督举报机制，加强监管措施，形成部门合力，实现源头打击治理。
一些乡镇干部说，打击土炼油点都是多部门执法，也搞过阶段性专项行动，但往往打击过后不久又会死灰复燃。运城、临汾等地相关人士表示，黑加油点、黑加油车 的监管查处涉及商务、消防、安监、工商、质监、环保等多个部门，但每个部门都“各管一段”，最终导致“都在管，却都管不好”。一位消防部门人员表示，如接 到群众举报，将发函联合商务、安监、辖区派出所对群众举报的加油站点进行现场联合执法，如不符合规定将按照消防部门相关条例进行查封，但查封后黑加油点的 取缔还要靠中国商务部门。
中国商务部门则反映面临执法尴尬问题。河津市商务局一位负责人说，河津市几乎年年进行专项行动，每年都取缔黑加油点。但由于油罐设备简单，制作成本低，黑加油 点极易死灰复燃。“监管就像割韭菜，每次检查都是治标不治本，甚至有的黑加油点会提前关门，风声一过，继续开业。”这位负责人说。
临汾某县商务局局长说，商务局对黑加油点、黑加油车的处罚仅仅是罚款。根据相关规定，处罚额度为经营者违法所得的三倍，罚金的上限是三万元，相比巨额的非法所得，对违法经营者的处罚没有震慑力。
也有相关人士认为，尽管各乡镇政府按照属地管理原则，负责辖区内打击取缔土炼油点、黑加油点，但是基层事务多，人员精力有限，难以及时有效查处。而一些劣 质油甚至来自周边省份，对成品油运输途中的监管超出了中国商务部门的职责范围，更加大了治理难度。此外，一些职能部门执法不严，甚至以罚代管，也是土炼油点、 黑加油点屡禁不止的重要原因。因此，须建立长效监管及隐患排查治理责任机制，只有相关部门积极履职、尽职，才能彻底整治“黑柴油”泛滥的乱象。
山西大学经济与管理学院教授耿晔强认为，当前，亟须建立起全面的群众监督举报机制。此外，还需要加强顶层设计，相关部门要形成合力，摸清黑加油点的产销链条，坚持做好源头管控，否则一旦土炼油点泛滥，黑加油点、流动的黑加油车形成规模，就会给治理增加难度。
吴璇、耿晔强等人表示，必须建立长效监管及隐患排查机制，同时要建立追责机制，政府相关部门要加大联合执法打击力度，多方努力才能根治土炼油点、黑加油点、黑加油车泛滥的乱象。
