日本拍卖中国流失文物被叫停
近日，有网友爆料，国家文物局向日本横滨国际拍卖株式会社发函，要求停止拍卖中国流失文物。根据网友提供的图片，这封《关于停止拍卖中国流失文物的函》中提到，上述日本拍卖公司原计划于10月29日至31日在日本东京举办“横滨国际2016秋季五周年拍卖会”，拍品中第734号唐代天王敦煌壁画、第735号唐代木质彩绘佛像人物故事壁画（三件）一组、第736号唐代木质彩绘佛像人物故事壁画（七件）一组、第737号唐代木质彩绘佛像人物故事壁画、第738号唐代释迦牟尼敦煌壁画、739号延昌-唐代国华佛典等手写唐经一批等标的为大谷光瑞等从中国非法劫掠的文物。
国家文物局要求该拍卖公司遵守相关国际公约精神，尊重中国人民的感情，停止拍卖这些非法流失的中国文物，并将对有关文物保留追索权利。此前，横滨国际拍卖相关负责人曾对媒体表示，确实收到了相关文件，调查后最终决定撤拍，将拍品返还给了委托人。
停拍文物系“从中国非法劫掠”
公函中提到的这些文物为大谷光瑞等从中国非法劫掠而来。大谷光瑞1876年出生，是日本佛教真宗派西本愿寺第22代法主，1902年至1913年期间，大谷光瑞曾先后组织过三支探险队深入中国西北地区，足迹遍布中国新疆、内蒙古、甘肃、青海、宁夏等40余座城镇，294个佛迹点。通过乱挖、乱掘和切割等破坏手段，在中国掠夺走了数以十万计的珍贵文物。这些文物多数是通过大连港登船运往日本，其中占比重最大的当数汉籍图书与碑拓，给中国文物古迹造成了极大破坏。大谷光瑞还是日本大正天皇的姐夫，在日本曾享有极高的社会地位。然而，据媒体报道，对于国家文物局公函中提到的几件标的为大谷光瑞等“从中国非法劫掠的文物”的说法，横滨国际拍卖相关人士仅表示“还没有最后核实”。
首次成功叫停海外拍卖中国流失文物
针对日本横滨国际拍卖株式会社撤拍中国流失文物一事，北青报记者昨日从国家文物局得到了证实。国家文物局表示，获悉日本某机构计划拍卖非法流失的中国文物后要求其停止拍卖，随后拍卖机构撤拍了相关文物。国家文物局强调，中国一贯反对并谴责买卖非法流失文物的行为，“对于任何确认为非法流失的中国文物，将保留追索的权利”，并“希望有关机构和个人认真遵守相关国际公约精神，尊重文物原属国人民的感情，不买卖非法流失的他国文物，不以此类文物为名进行商业炒作”。
据了解，这是国家文物局首次成功叫停海外中国流失文物拍卖。此前，2009年，在法国巴黎大皇宫举办的“伊夫·圣洛朗与皮埃尔·贝尔热珍藏”专场拍卖会上，圆明园鼠首和兔首铜像被法国佳士得拍卖行高价拍卖，引发华人世界的抗议潮。国内曾组织了近百人的律师团赴法抗争，国家文物局也曾多次约见并致函佳士得有关负责人，但终究没能阻止拍卖。
立法明确被非法掠夺的中国文物不得上拍
值得一提的是，在该事件发酵之前，国家文物局已印发了《文物拍卖管理办法》，其中明确指出，被盗窃、盗掘、走私的文物或者明确属于历史上被非法掠夺的中国文物等几类物品，不得作为拍卖标的。该办法比《关于停止拍卖中国流失文物的函》的签署提前了一天。
根据《办法》，不得作为拍卖标的物品包括：依照法律应当上交国家的出土（水）文物，以出土（水）文物名义进行宣传的标的；被盗窃、盗掘、走私的文物或者明确属于历史上被非法掠夺的中国文物；公安、海关、工商等执法部门和人民法院、人民检察院依法没收、追缴的文物，以及银行、冶炼厂、造纸厂及废旧物资回收单位拣选的文物。
国有文物收藏单位及其他国家机关、部队和国有企业、事业单位等收藏、保管的文物，以及非国有博物馆馆藏文物；国有文物商店收存的珍贵文物；国有不可移动文物及其构件；涉嫌损害国家利益或者有可能产生不良社会影响的标的；其他法律法规规定不得流通的文物。此外，《办法》中明确，国家对拍卖企业拍卖的珍贵文物拥有优先购买权。
