当天傍晚6点过，一辆公交车刚驶出李家坪公交站几十米远，吴先生踩着平衡车跟在公交车后面滑行。看着公交车右侧留出了一条狭窄的通道，吴先生认为自己应该可以穿过去，于是就继续向前滑行。然而就在此时，公交车的方向发生了改变，右后轮也越来越靠近右侧道路边缘。为了避让公交车，吴先生立即从平衡车上跳到了人行道上。而他的平衡车则失控继续行进，最终被卷入了公交车车轮下，完全损坏，零部件散落一地。
看见平衡车面目全非，吴先生很生气，要求对方进行赔偿，而公交车司机却认为吴先生不该将这种奇怪的车开到公路上，自己没做错什么。于是，双方拨打110报警求助。
双方各执一词

陈晔律师认为：根据《道路交通安全法》规定，只有符合条件的机动车，车管部门才给予上牌照。而电动平衡车不属于机动车范畴，无牌、无照、无保险，因此严禁上路行驶。车主在机动车道驾驶平衡车行驶，理应对此事故有所预见，而公交司机处理并无不当，同时现有证据也很难判断司机存有过错。故此，应由平衡车车主自身承担损失。
