要起诉腾讯与财付通公司的老人姓韩，今年67岁，是当事人小奇的奶奶，老人体弱多病，一个人带着13岁的孙子小奇和7岁的孙女，生活十分贫困。据老人说，老伴在十几年前就去世了，儿子染上赌博恶习，输掉了家里所有家当，还背着家人向亲戚朋友到处借钱，并欠下了巨额的赌债，最终离家外出躲债，已经几年没有和家里联系了，儿媳一气之下也离家出走。至今，家里只有老人一人，独自带着孙子孙女艰难度日。没有生活来源，老人只能靠拾废品卖点钱。这12000元钱，是家中所有的积蓄，是老人用来看病的救命钱，不知道积攒了多少年，没想到就这样被孙子8天内花光了。无奈之下，韩奶奶只能求助和县司法局法律援助中心，想要追回这笔钱。了解情况后，安徽和县司法局法律援助中心主任李兆光接受了诉求，并帮助不识字的老人向当地法院递交了诉讼状，李兆光律师介绍，诉讼的请求主要有两点，“在10月底的时候，我们就接收了这个案件，帮这个老人整理诉讼材料，准备起诉，起诉的主要内容就是请求法院判定小奇当事人，这个孩子与腾讯公司与财富通公司的这个买卖合同无效，给予撤销。二是要求两家公司退还小奇用于购买游戏装备的费用1万2千余元。”
对于钱款能否追回，李兆光律师表示：在此案中，小奇才13岁，在民法上属于限制民事行为能力人，他背着奶奶在8天之内花了1万2千余元，已经不在他的行为能力之内了，因此我认为这是无效的合同。
