海淀法院审理查明，2015年4月11日13时许，在一民办大学内，强某、李某某同两名女生走在路上时，因李某某低头看手机，差点撞上吴某的女友，强某和吴某双方遂发生争执。吴某说，“这儿人多，到我宿舍去，”4人就跟着吴某去了他宿舍。

海淀法院审理后认为，强某纠集张某、冯某等30余人，吴某纠集李某、陈某等20余人聚众斗殴，4人行为均已构成聚众斗殴罪。鉴于4人能够主动投案，又能主动供述主要犯罪事实，均为自首，且强某等3人在家属帮助下已赔偿吴某的经济损失并获谅解，故对4人均从轻处罚。另外，根据冯某、张某两人在共同犯罪中的作用，以及两人认罪悔罪态度，可对两人适用缓刑。

最终，海淀法院一审以聚众斗殴罪判处强某有期徒刑1年2个月，判处吴某有期徒刑1年，并均判处冯某、张某有期徒刑9个月，缓刑1年。
